of the Environmental Code and/or Regulation �•r�e Town of
Yarmouth Regulation for Sub-surface Disposa�o —Sewage.
Havin� determined that strict enforcement of the above Regulations '
in this instance would do manifest injustice and further, that Xour
requested variance does not conflict with the spirit of the Environ-
mentai Code or the Regulations of the Town of Yarmouth Board of Health,

detezmination and to issue a superseding order, the Conservation Commission shall
be a party to all agency proceedings and hearings before the Depar�ent.
10. Upon completion of the wrk described herein, the applicant shall forthvith requeet�
in vriting, that a Certifica[e of Compliance be iasued ata[ing that [he work has
been satiefactorily completed.
11. The vork ehall conform to the folloving descrlbed plana and� additional condi[ione:
. 12. All construction and locations shall conform �aith the plan
entitled "Site Plan and Sewage System" for Lot �., Dierchant
Ave. , Yarmouth. Drawn by Dovrn Cape Engineering and W VIS�il
April 3, 1979.
� 13. Any excess material excavated on the site and not used_ around
the foundation shall be removed from the site and deposited
only at a location approved by the Conservation Officer.
11�. All bank areas and disturbed areas shall be stabilized within
3 months of completion of the dwelling, ti•rith particular care
being taken on tthe west. property line abuttin� the Conservation
area.
15. There shall be a worlc limit line as shown on the revised plan
ivhich shall be staked out prior to any construction ti•aork.
IJo work of any kind vaill be allowed on the marsh side o£ this
line. "
� 16. The proposed driveway shall be bermed to direct sur£ace water
to the drainage pit.
17. Drywells shall be installed to contain roof runoff. �
1$. A temporary plank retainin� barrier shall be installed at the
rear of the proposed dtiaellin� to prevent erosion� if determined
necessary by the Conservation Of£icer.
i9• The Conservation Officer shall be notified at least 4� hours
before the proposed rrork begins. .
