Dear Richard:
I have reviewed the variance application you
submitted in regards to the above lot.
Enclosed, you will find, a copy of the var-
iances I have determined after reviewing the var-
iance application you submitted, and the revised
plans, dated January 3, 1985.
Therefore, will you review the variances I
have determined for applicability? I would like
to schedule a meeting, at your earliest convenience,
to discuss the variance request vs. the variance
requested at the previous Board of Health meeting,
as presented by Sweetser Engineering.
Thank you for your anticipated cooperation
in regards to the aforementioned matter.

DESCRIPTION OF VARIANCES

, LOT J-13 MERCHANT AVENUE, YARMOUTHPORT �
(1) 15.02 :17 - "Construction in Fill"
To allow primary leaching to be less than the required
25 ' removed around system, variance of 15 ' .
(21 15.02:17 - "Construction in Fill"
To allow reserve to be less than the required 25 ' re-
moved around system, variance of 15 ' to property line
and 10 ' to 15 ' variances to street.
(3) 15.15 (7) - "Required Depth of Pervious Material"
� To allow the installation of a subsurface sewage dis-
posal system in an area where there is less than a 4 '
I depth of naturally occurring pervious soil below the
i entire area of the leaching facility. (pXimary & Reserve)
(4) Town Amendments to Title S: Section 3.7; "Distances & Locations"
A) Primary Leaching - 20 ' variance £rom required 100 ' to
wetlands, to east side
B) Reserve Leaching - 5 ' variance from required 100 ' to
wetlands, to east side
C) Primary Leaching - 6 ' variance from required 100 ' to
wetlands, to south side
D) Reserve Leaching - 5 ' variance from required 100 ' to
wetlands, to south side
(5) Town Amendments to Title 5 : Section 3. 7 ; "No Fill. . . "
To :allow a variance from Section 3. 7; "No fill shall be
deposited when the water table is within four (4) feet of
the original grade" .
(6) Town Amendments to Title 5: Section 3 , 7; "Foundation Elevations"
To allow foundation elevation to be at 12 ' ; requiring a
variance of 4 , 2' , rather than the required 2 ' above the
high point in the road.
