Deep Test performed at right front corner of lot by Eldredge Engineers; witnessed by Health Agent, Dale D. Karnes. Soil Log consisted of Fill and Peat found - checked as unsuitable for sewage disposal system as 4 feet of.naturally occurring pervious soil was not observed, as required by the State Environmental Code - Title 5; CMR 15.00; Section 15.03:6: "Required Depth of Pervious Material". Sdil Log consisted of original, clean medium sand encountered between 1'� - 9 feet, with water at 9 feet. It was explained to him that � f � in de-watering tests to find the percolation rates below a water table r �� level, it still was no guarantee for approval; that a proposal must be �- g submitted to the Board of Health. � .r � o g February 17, 1982: �y Owner: David. Deep Test performed by Sweetser Engineers; witnessed by y�� Assistant Health Agent, David Carignan. Soil Log consisted of fill en- c � countered; equipment for de-watering not sufficient. � February 19, 1982: Town of Yarmouth's Conservation Commission notified Health Department that any future testing of Lot 13, Merchant Avenue will require prior contact with that Commission. February 26, 1982: Telephone call received from you, stating that lot was tested in past and original soil had been found. You then asked why further testing was required on this lot. I explained that 4 feet of naturally occurring per- ' vious soil must be verified around the area designated for the proposed septic system; that on July 14, 1981, I had informed you that further testing could possibly be required in this determination. In the research of this department's files it appears that no official ap- proval, in writing, was ever granted for the construction of a subsurface sewage disposal system on Lot 13, Merchant Avenue. The area of a proposed system must be 100 feet from a Wetlands area (Town of Yarmouth Amendments to Title 5: Regu- lation 3.7) , and meet with the State Environmental Code; Title 5: Minimum Re- quirements for the Subsurface Disposal of Sanitary Sewage. All requirements must be complied with prior to obtaining a Building Permit, therefore, I would recom- mend further testing, after first obtain3ng approval from the Conservation Com- mission, to locate naturally occurring pervious soil 100 feet from the Wetlands area.
