'This is an appeal from tie decision of the Building Commissioner, of March 27, 2002, relative to
the property at 15 Park Avenue, West Yarmouth. The decision would grant a building permit to
allow an addition to the front of an existing single family home. 'The decision is based upon the
calculation of the required front -yard set -back pursuant to bylaw §203.5, footnote I (allowing for
the averaging of the setback of the adjoining lots). The appeal contends that this averaging
provision does not apply to a "comer lot".
During the pendency of the hearing, additional information as to the history of the subject lot had
come to the attention of the Building Commissioner. As a result, by Ietter of June 26, 2002, the
Building Commissioner has now determined that the building permit, at issue in the appeal, will
not be issued at this time.
As a result of this most recent determination, the appeal of the petitioner is rendered moot, at this
time. The petitioner's attorney, by letter of June 27, 2002, requested that their petition be
withdraw with out prejudice.
Accordingly, a motion was made by Mr. Richards seconded by Mr. Igoe, to allow the petition to
withdrawn with out prejudice. All members voted in favor of the motion. The petition is there
withdrawn.
