Yarmouth MA Hello, Amy Van Hone told me you might contact me. She discussed the basement bedroom issue at 148 Run Pond Road with me a year or so ago, but it never proceeded further, and I have never been to the property. The Assessor's record of 148 Run Pond Rd. shows an unfinished basement. Alterations to this condition have never received permits from this department- building, plumbing/gas and electrical. The alterations that are apparently in place are therefore illegal. The owner of the property is responsible for all violations of building code and zoning, and such violations would transfer from the current owner to a new owner in the event of the sale of the property. Violations of this type are frequently noted by the Yarmouth Fire Department during their mandated smoke detector inspection near the time of property sales. IYs a good idea to take care of them before that point! The Building Department would require a building permit for all non-permitted construction, including electrical and plumbing/gas. This means everything that has changed the status of the basement from unfinished to finished, and includes removal of non-permitted work. A demo permit is itself a building permit. The building permit process includes a review by the Health DepaRment. While the Building Department does not count the number of bedrooms (we apply the standards for"sleeping spaces" to the entire structure), the Health Department does count them, and might require all such rooms in excess of the number of bedrooms allowed by septic regulations to be altered or removed. If the seller is not taking responsibility of the septic system upgrade, notification from the buyer to the Yarmouth Health Department by way of a letter indicating the septic system will be replaced by the buyer by a time certain (preferably 60 days or prior to occupancy) is required to be filed with the Yarmouth Health Department prior to the closing. 2. The existing septic plan (2010) on file at the Yarmouth Health Department will need to be updated to reflect the new groundwater elevation. The plan will need to be revised to reflect the new groundwater elevation, in addition to any additional system design changes required by the new groundwater elevation. The existing septic plan is available from the Health Department file for revisions. 3. The existing septic plan will also need to reflect the removal of (unpermitted) bedrooms located in the basement by way of changing the floor plan provided on the plan. Please be advised that any renovations on the building structure may require a building permit. This can be confirmed with the Yarmouth Building Department at X1260.
