Enclosed please find a copy of a letter I have sent to Carla Masse of One Centre Street Inn,
Yarmouth Port dated March 6, 2003 regarding violations. I feel it is important to keep your
office updated on this matter and I will forward copies of any future correspondence with them
to the Division of Food and Drugs.

This letter is to notify you that there are violations involving your property located at 1 Centre
Street Yarmouth Port that need to be corrected.
We are aware of the fact that you have been advertising, to the public as a "Coffee House". This
is a violation of the restriction on your business. Your Food 'Service permit explicitly states
that you may only serve to guests of One Centre. Street Inn. This restriction is due to
limitations of the septic system as well as a lack of approval by the Board of Appeals for zoning
variances to operate a Restaurant/Coffee House. If you wish to.;offer Food Service to the General
Public you must first ask for and be granted relief from Board of Appeals. Please speak to Jim
Brandolini who is the Building Commissioner/Zoning Enforcement Official. Septic system
issues should be discussed with the Health director, Bruce Murphy.
You also advertise selling coffee wholesale. To do so you must receive a permit from the
Massachusetts Department of Public Health, Division .of .Food and Drugs .to sell any food
wholesale. The Yarmouth Health Department must also be notified so that we may, reflect: this in
your file.
You have advertised your hot tub as available to guests. You: must first apply .for and receive a
Permit for a Hot Tub. In order to receive this permit you must have a Certified Pool Operator and
be in compliance with all applicable requirements as specified in "Minimum Standards for
Swimming Pools, State Sanitary Code, Chapter V" 105 CMR 435.000_ There may also, be
Zoning issues in regards to the use of the hot tub; Mr. Brandolini would be able:to answer any
questions regarding this use.
The present position of the hot tub is directly over. the distribution box of the septic systema The
hot tub must be moved as per Title 5 regulations for access to all components of .your septic
system. Please refer to your "as built" septic system diagram for proper placement of your hot
tub. You were previously notified of this violation by letter dated October 1, 2002.
Upon receipt of this letter you are hereby ORDERED TO CEASE OPERATION of the Coffee
House to the public, use of the hot tub and wholesale of coffee until all violations and issues
have been corrected and permits issued by Town of Yarmouth departments.

Failure to comply with this order will result in a Board of Health meeting andlor possible legal
