Dear Members of the Board
The owners of the property,Mrs.Maril}m Daly and Mr. Kieran Daly, at#8 Gulls Cove
Road, in West Yarmouth are requesting that a 3 bedroom septic system be installed on their
property and be discussed at the next regularly scheduled meeting on December 14,2015.
This property is not located in a zone II overlay or any other well protection district and the '
new Title V septic system will be in full compliance with Title 5 regulations for new
construction.
The original plan was prepared by Low and Weller,Inc. and dated 1982. The septic permit ',
was issued on April 1 l, 1983 for 2 bedrooms. This was a result of a variance requested by
the applicant at the time with regards to the over-dig required around the system.The 1978
Title V Regulations included a requirement that all over-digs around a septic system had to
be 25'in all directions.The variance required was a Title 5 variance.
With the redrafting of the current Title 5 septic design regulations in 1995,this particular
requirement was recognized to be extreme and has now been modified to be only a 5' over-
dig all around the system. With that 5' over-dig in mind a 3 bedroom septic system could
have been fitted on the property back in 1983.
Since the time of the original plan of 1983 and the current plan the wetland location based on
defmition has changed. The original plan had a distance of 100' to wetland and the proposal
in front of you today is 100' to that same location.However the definition of wetland is now
different to that of 1983 and as a result the wetland location has moved inland by defmition.
The new distance to wetland is 70.7' under the current regulations. This 70.7' horizontal
separation to wetlands is a town of Yarmouth variance as Title V only requires a 50'
separation. Engineers
Percolation testing was performed at the site in September of 2015 and a rate of 3 minutes ���ronmental
per inch was recorded which requires a separation distance of 4' to groundwater vertically ���ntists
from the bottom of the septic system. In an effort to offset the new wetland location and the Gis Consultar�ts
Town of Yarmouth By-Law we are proposing to exceed the minimum 4' requirement and i
hold a 5' vertical separation to groundwater from the bottom of the leaching area. Landscape

department had also been taxing the building as a 3 bedroom dwelling and it was only
recently that the Daly's became aware of the situation and immediately went to Mr. Murphy,
The Board of Health Director,to discuss their options.
