PETITIONER REQUESTS: A special permit under §104.3.2 to permit a 30' x 30' addition to the pre-exisiting, non-conforming warehouse and a variance from §203.5 to allow a 10' building set back in a G.B. Zone. Also, a waiver of rules and regulations as necessary and any . other relief that the Board deems met and just. ZONING ADMINISTRATOR PRESENT: Leslie Campbell It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Board to be affected thereby and that public notice of such hearing having been given by publicaiton in the Yarmouth Sun, the hearing was opened and held on the date first above written. Mr. DeWitt Davenport presented the petition. The site in question is an existing multiple business shopping plaza, in the General Business District. The present proposal is to allow for the expansion of an existing accessory storage building, located behind one section of this plaza. The existing warehouse is approximately 2,100 square feet in size, and the petitioner proposes to increase it by a 30' x 30' addition. The building will continue to be used for passive storage incidental to the operation of the existing businesses in the plaza. The petitioner requests, in the alternative, a variance or special permit. It is the petitioner's contention that only a special permit is needed pursuant of §104.3.2, in order to allow this expansion of an existing non-conforming structure. The addition will not create any new zoning non-conformance nor will it increase the present non-conformance. The existing warehouse is approximately 10' from the rear lot line, and the proposed addition will maintain that distance. However, the property abutting this lot line is also in use as additional parking for the plaza, but is in different legal ownership. If viewed as part of the same parcel, for zoning purposes, it would appear that only a §104.3.2 special permit were needed. If viewed as'a separate lot, however, than it would appear that a dimensional variance is also required, as the current rear-yard set back requirement is 20' . • r • .,,.1,.. she petitioner represents that the principal purpose for the addition will be to provide short-term storage of redeemed bottles and cans from the redemption center in the plaza. In the past, the bottles and cans have been stored in a trailer truck, which the Building Inspector has determined to be improper. After consideration of the matter, the Zoning Administrator is satisfied that, for practical Zoning purposes, the abutting lot is part of the locus, and threfore nb set back violation is presented by the addition. Therefore, the expansion will not be substantially more detrimental then the existing use. To the extent, if any, that • a variance is also required, he is also satisfied that the criteria for a variance are present and that the relief may be granted without substantially derrogating from the intent and purpose of the by law.
