Dear Yarmouth Merchant,
The Cape Cod Tobacco Control Program, in Gollaboration with the Yarmouth Health Department,
has recently completed a compliance check to detem�ine if minors (anyone under the age of 18)
could purchase tobacco products from your establishment. �
Minors were able to purchase tobacco in your store during a compliance check on the af�ernoon
of August 23, 1999. (Time-3:10 p.m.; Employee was fem�le,approaimately 25 years of age)'
Minors were sent into thirty (30) Yarmouth establishmerrts lic,ensed to.sell cigarettes to attempt
purchases. ff the clerk asked the minors their age or if the tobacco was for them, the minors told the
truth. It is against Massachusetts Law and the Yarmouth Board of:Health Reg�ilation for anyone to
sell tobacco products to people under the age of eighteen.
Please be advised this is your third violation. (The other violation dates were January 21, 1997 and
October 9, 1997.) You are hereby ordered to pay a fine of$200.00 as required by the Boazd of
Health To�acco Control Regulation, Section IX. You must also appear at a Board of Health
� 6earing schedule�for Monday, September 13, 1999 at 3:15 p.m at the Yatmouth Town Ha11 hearing
room. At the hearing, the Boazd of Health will det�rnune if your tobacco license should be
suspended,revoked, restricted or other penalties assessed. You or a representative must appear
at this hearing.
Please deliver the fine payment to the Health Department prior to the Board of Health hearing. ',
Please make your check payable to the Town of Yarmouth. '
For your infonnation,minors were successful in purchasing cigazettes at five out of thirty Yarmouth �
