Telephone (�08) 398-2231, Ext. 1241 — Fax (508j i60-3472 B O A R D O F H E A L T H October 8, 2010 Marian Majewski Jim Upton 29 Gingerbread Lane Yarmouth Port MA 026'75 RE: Poultry Violation Board of Health Hearing Dear Ms. Majewski and Mr. Upton: This department received a complaint that chickens were being kept on your property without compliance with the town poultry regulations and a Board of Health permit. On September 27, 2010, I visited the property and met with Mr. Upton to review the newly constructed chicken coop. I was informed there were eight chickens and no rooster. I informed Jim that the 4' by 6' chicken coop and attached 4' by 6' pen area do not meet the required poultry regulation set back of 50 feet from the north side (35 Gingerbread Lane) and rear property line (39 Thacher Shore Road) and 100 feet from these neighboring houses. Jim stated that he wished to proceed with a variance request to the Board A Board of Health hearing has been scheduled for Monday, October 18, 2010 at 5:00 PM in the main hearing room at town hall. At this time, the Boazd will determine if variances will be approved for maintaining chickens on this site. You must attend in order to present your case and the requested variances to the Board. At this time you must address the construction and maintenance of the chicken coop, storage of grain, manure storage and disposal and the requested set back variances. A site visit on October'7, 2010 revealed that a stockade fence was being installed along the property line of 35 Gingerbread Lane. You stated this was a request from the neighbor if the chickens were to reside on the property. The grain for the chickens was being maintained in a metal can with lid. The chicken manure was also being kept in a can with a lid and being removed from the property as necessary. A copy of the poultry regulation was provided to you at this time You must also contact Colleen McLaughlin, office administrator for the Old King's Highway Committee at 508-398-2231 X1292 as the committee must also review and approve the chicken coop. You may also contact the town's Agricultural Commission (Bill Snowden, chair, 508-280-$798) or you may be contacted by them for assistance in this matter.
