Per the bylaw definitions - Transient, at motels or hotels: For the purposes of the limitations of motel or hote! use, Transient occupancy shall be limited to the temporary and short term occupancy, ordinarily associated with motel and hotel use. Transient occupants must have, and be able to demonstrate that they marntain a principal place of residence elsewhere. Transient occupancy shall generallx refer to ' continuous occupancy of not more than thirty (30) days, and an aggregate of not more than ninety (90) days within any six (6) month perrod. Use of a guest house as ' a residence, or dwelling unit, shall not be considered transient. This definitian does ' not appiy to On-Site Property Managers at Motels/Hotels. Your submission of information to the Yarmouth Police Department indicates that one or more of your guests were tenants staying in a unit exceeding the 30 day limit. If these violations do exist, you are hereby ordered to cease and desist all illegal occupancy of the motel rooms in question immediately and make proper application for and receive a special permit and or use variance to occupy the units legally. This department does not have record of applications / permits and or variances allowing the use of the aforementioned units legally. ' Failure to comply with the provisions of the Town of Yarmouth zoning bylaw could result in fines up to $300.00 per day, per violation. Each day that such violation continues shall constitute a separate offense.
