Dear Mr. Renaud,
I am in receipt of your letter dated January 19, 2016 pursuant to Massachusetts generaf (aw 105
CMR 435.05(3)that " No projections except ladders and grab rails shall be oermitted from any
pool wall or floor surface" at the following locations.
• Green Harbor Resort. 182 Baxter Ave West Yarmouth, MA 02673
• Blue Rock Motor Inn. 39 Todd Rd. South Yarmouth, MA 02664
• Red Jacket Beach Resort. 28 South Shore Dr. South Yarmouth, MA 02664
• Kingsbury Garden Apartments. 193 Camp St. West Yarmouth, MA 02673
The second variance issued is in regards to Massachusetts general law 105 CMR 435.13(1)that
"walkways shall be continuous around the pool with minimum width of four feet of
unobstructed clear distance including the curb at the pool edge, if such curd is used" at the
following locations.
• Riviera Beach Resort. 327 South Shore Dr. South Yarmouth, MA 02664
• Thirwood Place Retirement Community. 237 North Main St. South Yarmouth, MA 02664
• Red Jacket Beach Resort. 28 South Shore Dr. South Yarmouth, MA 02664
• Blue Water Resort. 291 South Shore Dr. South Yarmouth, MA 02664

Re: Pools variances—Stairs Projecting into Pool

Based on inspections from the fall 2014 of your pool, it was noted that your pool would
need a variance from the Board of Health based on a violation of the state swimming pool code
of minimum standards regarding stairs projecting into your pool.
Reference 105 CMR 435.05(3)which states "No projection except ladders and grab rails shall be
permitted from any pool wall or floor surface." "The State Department of Public Health does
not grandfather stair projection into pools. DPH requires stairs to be recessed /outside of the '
swimming area." '
At the Board of Health Hearing in the Spring of 2015 for your variance proposal from 105 CMR
435.05 (3)the Board approved the variance request with a condition requiring all projecting
stairs in ool
p must be pamted/marked with a contrasting color of four(4) inches from the edge
on the rise and run of each step (top and front)to ensure visibility of the protruding stairs when
entering and exiting the pooL
Please respond within 10 days of receipt of this letter, of when this work will be completed.
Your pool will Not be allowed to oaen for the 2016 season until this work is completed.
