Dear Mr.Huynh:
Prior to your receiving your 2007 motel licenses,you received a notification letter from this department stating that motels
must be in compliance with the new town transient occupancy definition. Motels that were in noncompliance would be
scheduled to come before the Board of Health to discuss their motel licenszs.
As you are aware,the Board of health is reviewing motel licenses prior to issuing the 2008 licenses to ensure compliance
with the Town of Yarmouth transient occupancy definition as adopted at this year's Annual Town Meeting.
TRANSIENT OCCUPANCY: For purposes of limitations of Motel or Hotel use, Transient occupancy shall be
limited to the temporary and short tem occupancy ordinarily and custamarily associated with motel and hotsl use.
Transient occupants must have and be able to demonstrate that they maintain a principal place of residence elsewhere.
Transient occupancy shall generally refer to continuous occupancy of note more than thirty (30) days, and an
aggregate of not more than ninety (90) days within any six (6) month period. Use of a guest unit as a residence or
dwelling shall not be considered transient. Occupancy that is subject to the collection of Room Occupancy Excise, as
defined in M.G.L.c. 64G or 830 CMR 64G,as amended,shall generally be considered Transient.-
I informed you during a site visit that, because there are a couple of long tenn rentals at the property, you would need to
attend a Board of Health meeting. At this time, your 2008 motel licenses would not be granted based upon this
information. A Board of Health meeting is scheduled for Monday, October 15, 2007 at 3:10 PM at the Yarmouth
Town Hall in the downstairs hearing room. You or a representative must be present at this meeting.
If your motel permits are not granted for 2008,you will need to contact the Euilding Commissioner/Zoning Inspector for
a determination for future zoning use of your properties. For any unit that is rented, you will need to contact the Health
Department for a rentaUlease registration.
