REVISED SUPPLEM�NT TO P4INIP�UN: SA�ITATIO�: STAVDARDS
FOR FOOD SERVICE ESTABLISHi^E�v�TS
OUTSIDE CAFES
The followine regulations are promulgated by the Town of Yarmouth
Board of Hea�th, in accordance �rith the provisions o� Cha�ter 111 ,
secti�n 31, as amended, of the Massachusetts General La4�s . The
applic�nt shall refer to the State Sanitary Code for basic require-
ments .
The followinq are some of the criteria that must be met orior to
the Board ' s consideration of a variance from 1J5 C'�1R 595 .000 State
Sanitary Code Article X: Niinimum Sanitation S�andards for Food
Service Establishments .
a) A�plicant must submit anplication to, and be a�proved by, the
Town Site Plan F.eview Comnittee .
1) a site plan will be required accordinQ to Section
1432 of the ZoninQ By-la�� to assure compliance with a11
applicable codes.
b) Sufficient restrooms , bot!� for customers and e�ployees , must be
furnished,' 'cour.ting tY:e additional outside seatinc as rectuired bv
the State Plumbing Code . � � '
c) The e:cistinQ sub-surface se�aace syste*^ must �e determined ade•�ua=z
to the Boar� of Fiealth for the iro;�osec a�3it�onal seaLs, accorc�ng

. d) SeatinQ capacity shall bP �e�ermined by the Board cf Health after
subr,:ission of plans and :�isual inspection.
e) The dinina area must be set back ter. (10) feet fro� the propert�
line, sidec,;alk, or public access way (parkina lots, etc .) . A
divider, such as a small fence, shrubs, etc. , must mar� the
desi�nated setbac?c.
f) The dining area must be part of the restaurant property whether
leased or owned. The dining area must be mer_tioned on the described
premises as in the case of a Comn:on Victualler ' s License.
g) A self-contained drainage system desi�3ned to eliminate odors will
be required for all outside dining areas . Conveniently located
hose bibs must be available for washing down the dinina area.
hj Provision must be made bv the aaplicant to protect against t:�e
entrar.ce of rodents , flie= , roaches , and ot'�er ver:�in , into the

i) Trash dumpsters shall be situated no closer than 5C feet from an.
outdoor dining area. If such a dumpster is in the line of sight
from the dining area, it must be hidden from view by a stockade or
other such fencing. The area around the dumpster and stockade
must be kept clean and free of litter. Dumpsters must be kept closed
with adequate covers designed to prevent entrance of rodents and
vermin and completely free of odors .
j ) The patio or other dining area surface must be of such construction
or material as to be readily cleanable and not be susce�tible to
inordinate amounts of dust, mud or debris . (Brick, tile, concrete,
or similar ty�e washable surface, would be e:camples of acceptable
material) .
k) Table tcps must be so designed and of such material and workmanship
as tc be sr,tooth, non-porous, easily cleanable and durable; and sha�1
be in such repair as to be readily maintained in a clean and sanitarv
condition. `
1) A menu shail be submitted to the Board at the time of a�Dlication
for a variance. Any addition or variatior� of the menu must be sub-
mitted to the Health DeAartment for approval . �
m) Food service personnel must continuously police the dining area for
paper and other trash . Placemat clips, cup holders and other such
devices must be utilizec to prevent blo�aing paper. Covered trash
receptacles must be provided in close proximity to the dininq area,
and must be kept from over-flowing.
n) Strict clean-un practices must be achered to . Alaitr�sses , waiters
and/or buspersons must be emnloyed to c�ean up aiter eac:� patron
as in indoor dining . Eac: establis;.:-ien� must abice by all regulations
contained in Article X, t�iinimum SaniLat�on Standards for �ood Service
Establishme^.ts of the Commonc�ealth of `-iassac:�usetts , De�artr�ent of
Public Health Sanitary Code . .
oy Outside food handlers must have easy access to hand�aasr, sinks, �
clean cloths, and to fac�lities where sanitizinQ solutions can be ,
easily prepared �ar.d dis�osed of . r
p) Hair nets or ot�.er ef�ective hair res���ints suc'� as hats covering
all eYposed hair shall be worn by ail outside food or drin?s handlers .
Beards and �:ustaches must be neatly tri:-�med.
THE ABOVE CRITERIA ARE NOT INCLliSIVE AND ARE ONLY FURNISHED AS A GUIDE-
LINE. THE BOARD RESERVES THE RIGHT TO DENY VARIANCES FOR ANY OTHEP,
CONDITIONS THAT MAY APPLY TO SPECIFIC LOC�TIONS . ANY VARIA�ICE GR�NTED
BY THE BOARD MAY BE REVOKED FOR ShVITARY VIGLATIONS AFTER AV OPPORTU:�ITY
