Re: Pool Variance Requirements
The below excerpt is from 105 CMR 435.000 "Minimum Standards for Swimming Pools, State
Sanitary Code, Chapter V"
105 CMR� 435.23 Life�uards
(1)The operator shall provide one or more lifeguards 16 years of age or older if the Board of Health
determines that they are necessary for the safe use of the swimming or wading pool. The Board,when
determining whether there is a need for one or more lifeguards and the number of on-duty lifeguards to be
present at the p�l at any one time,shall take into account the size, shape and capacity of the swimming
or wading pool.
(2)ff no lifeguards are required by the Board of Health,a warning shall be posted in a conspicuous
location and shall state"WARNING-NO LIFEGUARD ON DiTi'Y"in easy to read,legible letters which
are at least four inches(ten cm)high.In addition,there shall be signs which are readity visible stating
"CHILDREN UNDER AGE I6 SHOULD NOT USE SWINIlVIING POOL WITHOUT AN ADULT IN
AT'TENDANCE"and"ADULTS SHOiJLD NOT SWIM AL�NE."
As an establishment with a semi-public pool that has received a Yarmouth Board of Health
variance from this code,you must ask for this variance in writing for this and every year .
AND provide an annuat report answering the fotlowing:
1. Is access limited to owners and guests only?
2. Are gates locked at all times, either keyed entry or combination?Are gates self-closing and
self-latching? '
3. Has a"Swimmer's Log"of daily bather load been maintained during the season and the
results submitted(with the next year's applica.tion)to the Health Dept.? :
4. Has a"Sa£ety Log"of any reported accidents (if any)been maintained during the season and
the results submitted(with the next year's applica.tion)to the Health Department?
5. Has the Certified Pool Operator(CPO)supervised chemical and physical maintenance of the ,
pool and signed the"Daily Pool Log"for chemical baiance on a weekly basis?
6. Was the Water Chemistry tested for balance four(4)times per day of use?
7. Was Bacteriological Testing for coliform bacteria and Pseudomonas performed by an '
accredited lab before the pool was opened?Were the results acceptable?If not, was there
immediate remediation witl�a follow up sample tested?Was testing done again in August as
per State Code? � ��
8. Was a formal inspection by the Yarmouth Health Department along with the CPO performed
before the pool was opened?

10. Were a11 safety signs posted as required by the Town of Yarmouth?
11. Were all safety signs posted as required by the State of Massachuse�tts?
12. Was the pool in compliance with all other local and State Swimming Pool regula.tions?
Appearance before the Yarmouth Board of health is not necessary to process your
applicatian. Please submit these reports as soon as possibte to ensure a timely opening of
your pool when the season begins.
