To date, we have not received a reply to our request. The placement of any material into a navigable waterway or wetland area is regulated by the Department of the Army under Section 407 of Title 33 of the United States Code. Therefore, permitting the fill and bulkhead material at the River View Motel to wash or fall into the Parkers River is in violation of this Act. We once again request that you submit a drawing of the proposed repair work as well as an explanation of any other measures you are planning to remedy this situation. Failure to respond within 30 days from the date of receipt of this letter may result in the initiation ofappropriate legal action. You will note that there is now outstanding a preliminary injunction against Riverview Inn, Inc., Gateway Construction Company, Inc. and Radford B. Anderlot, Trustee of Darlot Realty Trust. There is also an interlocutory order continuing the restraining order against Robert Welch, Trustee of Riverview Trust. It is my opinion that unless your Commission or Mr. Johnson has determined that the defendants have violated the preliminary injunction and restraining order, there is no value in proceeding with any further legal action at this time. A copy of the above statutes are annexed hereto and marked "A" and "B". The Defendants have been the owners of a parcel of real estate known as the "Lighthouse Botel" in Yarmouth. There is located on said real estate a motel. The motel sits astride a tidal estuary known as "Parkers River." On April 1, 19-0 the Defendants filed a notice of intent with the Yarmouth Conservation Commission, pursuant to M.G.L.A. c. 131 §40. On May 18, 1976 said Commission issued an order of conditions. As part of that order of conditions, the Defendants were ordered to construct a bulkhead on said river according to the plans supplied by the Defendants. The order of conditions has been violated in that: • • BIANCHI AND PAQUIN ATTORNEYS AT LAW 712 MAIN STREET POST OFFICE BOX 128 HYANNIS. MASS. 02001 TELEPHONE (617) 775-0781 -- 2 1. The Defendants failed to obtain a license pursuant to M.G.L.A. c. 91 as required by the Department of Environmental Quality Engineering. A copy of the request by John S. (Section 15 of order of conditions) 4. The construction of the. bulkhead was not done in strict conformance with.the final revised plans. (Section 17 of order of conditions) 5. pipes, outlets, drains protrude through the bulkhead. (Section 20 of order of conditions) Because. the bulkhead was not constructed in conformance with the order of conditions, it is in a state of disrepair and is i.n danger of collapsing into Parkers River. The Plaintiffs state that if the Defendants do not Immediately undertake steps to make safe and secure the bulkhead, it will collapse into the river. The plaintiffs state that the collapse of the bulkhead would destroy, valuable natural resources, shellfish, etc. and adversely affect the ecological system of the river. • BIANCHI AND PAQUIN ATTORNEYS AT LAW 712 MAIN STREET POST OFFICE BOX 128 HYANNIS, MASS. 02601 TELEPHONE (017) 775.0786 - 3 - Argument M.G.L.A. C. 131 §40 is commonly referred to in the Wetlands Protection Act. Its purpose is to regulate the removal, filling, dredging and altering of land bordering waters. It gives to a conservation commission the power to impose restriction, And orders on such activities and to enforce the same. Any court having equity jurisdiction may restrain a vi:0la,tion of M.G.L.A. c. 131 §40 and enter such orders as it deems necessary to remedy such violation. The Plaintiffs are in need of such relief to Prevent temporary and permanent damage to the river And its resources. M.G.L.A. c, 214 §7 is a statute designed to remedy activities which cause damage to the environment. Irreparable damage will result unless the Court takes immediate action to order the Defendants to make secure the bulkhead and to prevent its collapse, Should the Defendants not secure and make safe the bulkhe.adp damage to the river and its resources will occur. Yarmouth, MA 02664 Dear Mr. Anderlot: During a routine inspection it was noted that a portion of Your existing bulkhead along the Parker's River at South Yarmouth, Massachusetts is in a state of disrepair and that at some spots sand fill from behind this bulkhead has washed into the waters of the Parker's River. Anderlot The Riverview Inn, Inc. 477 Main St. Yarmouth Port, Mass. 02675 Dear Mr. Anderlot: In reference to our discussion yesterday relative to the Bulkhead, I have examined the Bulkhead and also taken the necessary measure- ments to determine the amount of fill required behind the Bulkhead. I have also prepared a typical cross sectional drawing of the Bulkhead as it was constructed. The typical cross section of the existing grades is shown on the dr-awing and also the fill required to bring the area up to final grade. The Bulkhead location is shown on the sketch plan of land in South Yarmouth, Mass. by Edward E. Kelly, R.L.S., Revised August 9, 1976. The following should be done prior to back filling to insure the integrity of the Bulkhead. An additional pile should be placed on the Southwest corner of the Bulkhead retained and fastened in the same manner as the other piles. This should also have a 1" rod, 20' long, going into an 8" diameter anchor pile. There are 3 piles which do not have anchor rods and piles and these should be provided. In each case where there are two rods going to one anchor pile, one rod should be removed and a new anchor pile installed for this rod. All spaces between the 3" x 10" long tongue and groove sheeting should be blocked to prevent the back fill from seeping into the river. All the rods should be checked to make sure that they are tight and the Bulkhead is held vertical and in line as the Bulkhead backfilling progresses. Any of the wales or sheeting that are damaged or broken during the construction and backfilling should be repaired as they are ob- served, and backfilling in that area discontinued until the repairs are completed. ...continued.......... I • Mr. Radford B. Anderlot -2- • September 9, 1976 Special precaustion should be taken during backfilling in the Southwest portion of the Bulkhead for approximately 85' where there is an extension of the sheeting below the lowest wale. The amount of fill required between the Bulkhead and the existing grade to bring the fill level to the top of the bank is approxi- mately 322 yards. The amount of fill to bring the grade from the top of the bank to the final level in the area between the top of the bank and the Bulkhead is approximately 171 yards. U SUGGESTED ADDITIONAL CONDITIONS In addition to the approval as requested by the Commission for (A) a grade change, and (B) foundation location and auxiliary facilities, the following additional conditions might be imposed by the Commission to insure maximum protection for all parties: A. That the Massachusetts Department of Environmental Health Regional Office in Lakeville, will have reconfirmed their approval of the sewerage plan for this site with the deletions as filed with this Commission.. . B. That a new bulkhead included inthe application under the heading "Auxiliary Facilities" be constructed above mean. high water mark as shown on a drawing entitled "Site Plan Revised 4/24/76" and submitted herewith. C. That the auxiliary facilities shown as an existing bulkhead of approximately 4S feet on Parkers River and approximately 45 feet on the marina side of the property be repaired. D. That the ground floor elevation of the proposed building shall be raised from the 109.5 feet as shown on the plan sub- mitted to 110.5 feet. Minor adjustments in other grades to be made to accommodate same. E. That additional catch basins be installed within the property boundaries on both sides of Neptune Lane as prescribed by the Town Engineer. F. That the area on the easterly side of Neptune Lane be regraded so that drainage is toward Neptune Lane. In addition petitioners feel strongly that in order to improve the appearance of the parking area they would like to utilize landscaped areas and planted trees to separate groups of parking spaces. Therefore, an additional condition might be imposed as follows: G. That the parking area be redesigned into 10 x 20 foot parking spaces with additional parking to meet zoning requirements to be provided in the area designated for sewerage system #7. McAbee McAbee Real Estate 477 Main Street Yarmouth Port, Mass. 02675 Dear Mr. McAbee: This is your authority to act as our agent at a meeting of the Conservation Commission as it relates to your client's interest in the property owned by this corporation, and located on both the east and west sides of Neptune Lane immediately south of the Gateway Restaurant. Approximately six years ago I intended building a 100-room motel on this site, but built a motel here in Rhode Island instead. In that connection, however, we submitted complete plans and speci- fications and were issued a building permit by the Town of Yarmouth; and Bob Eldridge drew up the septic tank and leaching field system which was approved by the Health Department in the Town, and was also approved by the State authorities in Middleboro. Percolation was excellent, and the permits were issued. Kindest rega d , Y _qON-KRUCTION CO., INC. R. A Bernardo RFB: jl WETLAND PROTECTION ACT • ENVIRONMENTAL DATA FORM 1. ALTERNATIVES TO PROPOSED ACTION a) Barren site could continue to errode 1. Describe alternatives to the into Parker's River (Periodically requested action dredged by town and state)_ - b) Adjacent restaurant site & parking could be increased but owners don't have sufficiaat business to warrant. c) Adjacent Marina could be expanded but Parker River wouldn't support substantial additional congestion 1 . 2. Describe the benefits of the requested action over the alternatives i a) Erosion of land and siltation of river will essentially cease. Ground cover on site particularly along the river's edge, while planned to beautify, should also encourage certain birds, not presently attracted to site, since there are no berry bushes or evergreen trees../ b)Not--viable because of insufficient seasonable business. Proposed action would lengthen restaurant season and allow them to keep more employees for a longer period of time. c) Not viable due to boating congestion unless some dry land, boat stacking areas added, which be unsightly, as screening of site would be 'virtually impossible. Mariners fishing party .. boat business would have a longer and better season. Generally, a barren eroding piece of land would be improved visably, and flora 8nd fauna wise, to some extent. The unemployment rate and resultant welfare load so high on Cape Cod, would be reduced. The tax base for the Town of Yarmouth would be broadened. Seasonal visitors unable to find satisfactory accomodations would be better served up* when marginal seasonal facilities are closed. This proposed facility would be attracting visitors when they are most needed to benefit the Cape's human resaurces during off_season.,/ - 28 - i i r
