Schultz Re: Beach N Towne & Capt Jonathan; Pictures and Other Info . � c STATEMENT OF CHRISTOPHER E.SCHULTZ AUGUST 20,2007 Sagamore Hospitality is a small,family owned business that owns and manages the Beach 'n'Towne and Captain lonathan Motels. We purchased the Beach 'n' Towne motel in 2004 from Ralph and Sue Burgess,at which time my�ancee and I moved in as the onsite managers. Since our stewardship began, we have been able to increase the rates from $75 per night to almost $100 per night, consequently generating more tax revenue for the town from this property than previously earned. The Beach 'n' Towne has also been ranked as the number 1 hotel in South Yarmouth, based on traveler reviews and third party sources on tripadvisor.com (Appendix A),a website oriented toward experienced travelers. In 2005, our family purchased the Captain Jonathan Motel from Attique Siddique. At the time of purchase Mr. Siddique misled us indicating that the hotel was operating at high occupancy and had a high incidence of repeat guests. What he did not tell us was that he was using the hotel as housing,with rooms serving as de facto apartments. The"repeat guests"were in fact living on site and were using the facility as a primary residence. We were also misled as to the condition of the building. The rooms, based on our inspections were tired, but seemed to be in relatively good shape. We were not made aware of the numerous insect problems rampant in the hotel. There was an infestation of bedbugs in several rooms in the facility, of which we were not made aware until the issue was brought to our attention by our guests. Despite these issues, we have been progressively working toward the redevelopment of this property into a viable, attractive hospitality option to mirror our work at Beach 'n' Towne. We have addressed and effectively dealt with the bedbug issues through an aggressive treatment program in partnership with Teminix. (Appendix B) This includes the prompt and satisfactory resolution of a guest complaint that was later investigated by the Yarmouth Health Department and cleared for occupancy. None of the residents of the facility at the time of purchase are present on site any longer. In late 2005, a new Title V septic system was installed by Enright Construction under the supervision of engineer Ed Stone of EAS Services. (Appendix C) We have also, despite limited funding, continued the process of resurfacing the parking lot, addressing landscaping issues, and an aggressive revitalization and renovation of guest rooms with new"knockdown" wall texture, new chair rails,furnishings,window treatments, sink vanities, etc. (Appendix D) We also have contracted and emplayed the services of Re- Bath to repair and renovate distressed bathtubs in several rooms. (Appendix E) All of these efforts are designed to improve the overall guest experience. Our goal at the hotel is to complete the internal renovation process by spring of 2008. The progress is moving slowly, and with limited funding most of this wark needs to be done internally. Currently, general maintenance and painting, etc. is being done by my father, the property owner, alongside the resident caretaker of the property. Once this work is completed, work on the exterior will begin. The current plan includes power washing and repainting the hotel with a more appropriate and attractive � : � color which represents the colonial feel of old Cape Cod, repairing and replacing damaged portions of the wood framing, major landscaping changes and new, more attractive and appealing fencing around the outdoor pool, to provide better security for our guests while making it an attractive feature of our facility. When this work is completed, we intend to re-brand the hotel as the "Beach `n' Towne Too", and it will serve as an adjunct resort hotel facility to the Beach 'n' Towne, much in the same way that the Cape Traveler and Mayflower hotels serve as an adjunct facility to the Irish Village. The Captain Jonathan Motel is currently being used as a hotel geared toward extended stay guests, much like a Candlewood Suites, Residence Inn, Homewood Suites or Extended Stay America property. We welcome overnight guests with open arms, however our current operating module is designed to limit costs for long-term travelers_and workers. In exchange for affordable lodging, our guests are not paying for many of the extras usually associated with leisure travelers. Currently, the cottage onsite serves as the primary residence for the property owner, Henry E. Schultz. In addition, the property caretaker also resides onsite. There is a consistent presence on property and avaiiable, as well as a management presence at the Beach`n'Towne o�ce. Realizing that there is an issue with"residency" in hotels on Cape Cod,,measures are taken at our facility to ensure that this is not the case. Currently, all of our guests are required to sign a weekly, non- resident guest agreement. (Appendix F) This agreement not only requires standard hotel practices such as housekeeping and maintenance routines be observed, but it maintains that the rooms are not equipped as residences and do not provide cooking surfaces or facilities aside from a microwave amenity. It prohibits the guest from bringing in cook surfaces of their own. Full Service Housekeeping (provided each 7 days) includes dusting, vacuuming, changing linens.and towels, emptying trash, cleaning of bathroom, and replenishing soap and toilet paper if needed. Additional Full Service can be purchased at$10 per service. Guests of the hotel are not permitted to receive mail at the hotel, nor are they allowed to list the hotel address as a legal address. Most importantly, the arriving guest must produce at check-in a legal form of identification and verification of a permanent address. As a result, the current guests at the Captain Jonathan motel are mostly laborers and seasonal employees. These guests depart after their work is completed and return home to their permanent addresses. During the summer, our guests tend to be service industry employees and students here for summer work. In the off season this tends to shift to laborers performing renovations and construction in the area during the off season. Since our stewardship of the Captain lonathan Motel began, there has been a significant drop in calts to the Yarmouth Police Department for domestic issues and illegal activity. There are no problems on site with drugs or prostitution, and since most of our guests are working locally and early in the morning, noise is at a minimum in the evenings. Realizing this hotels unique geographical positioning as part of the Bluestone Group's recommended town center development, we feel that the Captain lonathan, soon to be the Beach 'n' Towne Too, use � ., � is best served as a resort motel facility. This is the direction in which we are taking this hotel: From a tired nuisance along route 28 to a destination resort motel. It is this information, along with the direction in which the hotel is moving that we would like to specifically address the concerns raised in Mr. Murphy's letter to us, dated August 13, 2007. The old manager's unit is currently being used as an apartment, and we agree that this is a use that will need to be addressed and reviewed with the zoning board. It was assumed, incorrectly, that it could serve as a rentable apartment, since it was acceptable as a "manager's apartment, and we are willing to work quickly to correct this oversight. Aside from this, as outlined above, the motel is NOT being used as apartments. All of our guests are accounted for and are aware of the temporary nature of these units and their occupancy. Any and all units can be vacated at any time and can be used for nightly or new weekly use. For the ease of administration, all administrative functions have been consolidated at the Beach 'n' Towne, but all operational functions remain centered at the Captain Jonathan Motel under the property owner's supervision. This includes an independent housekeeping and maintenance function on property, managed by the onsite caretaker. All telephone calls and charges are handled by the third-party carrier identified in Guest Room. 19. Guest agrees to maintain personal effects in a neat and tidy fashion so that the housekeepers can clean Guest's room effectively during the above scheduled cleaning days. No articles belonging to Guest may be left outside the mom(barbecue gri.lis, laundry, toys,lawn furniture,etc.). 20. Guest agrees to obey and comply with all applicable State and Local fire regulations covering multi-unit dwellings. No outside cooking,except in areas designated by the Motel,is permitted by order of the State Fire Marshall. 21. No guest mail may be delivered to the address of the premises. Any such items arriving may and will be discarded or marked "Retum to Sender". 22. A standard issue of two towels, hand towels and wash cloths per room, along with linens has been placed in your room. Additional towels will not be issued. However, clean towels or linens may be exchanged one for one in the Motel office. Initial room supplies (such as soap, cups, toilet paper, etc.) are provided. Additional further quantities are the responsibility of the Guest. After a two-week period,the guest will be required to provide their own bed linens and towels. Housekeeping service is srill required as stated in the next item in the Agreement. 23. Full room cleaning service will be provided once a week. Full room cleaning service consists of cleaning the shower/tub,toilet, bath floor,sink,replacing any towels present at the time of cleaning,changing the bed with fresh linens,removing trash in the trash cans,and sweeping and dusting any unobstructed surfaces. Additional trash must be taken to the outside garbage cans by the Guest. Guests who have obtained their own linens are still required to take service. Service will consist of the same procedure as a full cleaning,minus changing bed and towel linens. SERVICE MAY NOT BE REF[TSED ON THESE DAYS. 24. If Guest violates any term of the Agreement, including without limitation, any of the rules and regulation contained herein,the Motel shall have the right to terminate the Agreement and cause Guest to vacate the premises immediately. Guest agrees and represents that the use of the Motel's facilities, including but not limited to occupation of a room, shall be undertaken at Guest's own risk and the Motel sha11 not be liable for claims, loss or damage to Guest or GuesYs properiy,which arises wholly or partially due to the negligence of Guest or his Visitors, arising out of or connected with the use of any of the services,facilities and/or premises of the Motel. � GUEST HEREBy RELEASES AND FOREVER DISCHARGES THE MOTEL FROM ALL SUCH CLAIMS,LOSSES OR DAMAGES AND GUEST COVENANTS NOT TO SUE THE MOTEL IN CONNECTION THEREWITH. � 30. If Guest fails to pay any Weekly Rates or other charges due ; hereunder, or otherwise defaults with respect to any provisions of the Agreement , Guest shall not, without the Motel's % permission,remove,sell or otherwise dispose of any of the Collateral,and the Motel shall have the right to take possession of the Collateral,and the Motel may exercise from time to time any rights and remedies available to it under applicable law as in effect at the time in this State or otherwise available to the Motel. Any notice of intended disposition of the Collateral required by applicable law sha11 be deemed reasonably and properly given if delivered personally to Guest or if mailed by first class mail, { postage paid,to the GuesYs address as given to Motel or to any forwarding address of Guest as furnished by Guest to the Motel � in writing. 'The remedies provided for herein shall be in addition to all other ri�hts and remedies of tlie Motel under tlus �� Agreement and under applicable law. 32. Upon the expiration or termination of this Agreement,'Guest shall remove at Guest's own expense all consumer goods and other � personal property of the Guest brought upon the Motel's property. In the case of injury or damage to the Motel's properly resulting from the removal of the Guest's personal property, Guest shall promptly pay to the Motel the cost for repairing such ' injury or damage, together with Interest thereon. Guest shall complete such removal by the e�iration or termination of this Agreement. The laws of the State shall apply in the application, enforcement, and interpretation of the Agreement.
