Motels that were non-compliance would be scheduled to come before the Board of Health to discuss theii motel licenses. As you are aware, the Board of Health is reviewing motel licenses, prior to the issuance of the 2008 licenses, to ensure compliance with the Town of Yarmouth transie�t occupancy definition,as adopted at this year's Annual Town Meeting. TRANSIENT OCCUPANCY: For purposes of the limitazions of Motel or Hotel use,Transient occupancy shall be limited to the temporary and short term occupancy, ordinarily and customarily associated with motel and hotel use. Tr�nsient occupants must have and be able to demonstrate that they maintain a principal place of residence elsewhere. Transient occupancy shall generally refer to continuous occupancy of nat more than thirty (30) da.ys, _ and an aggregate of not more than ninety (90) days within any suc (6) month period. Use of a guest unit as a residence or dwelling unit sha11 not be considered transiern. Occupancy that is subject to the collection of Room Occupancy Excise, as defined in M.G.L. c. 64G or 830 CMR 64G, as amended, sha11 generally be considered Transient. I visited the motel on August 3, 2007. The front desk employee had a file on each occupant. She stated that the Beach `N' Towne aversaw management of The Captain Jona.than Motel,but was unaware of where the guest log for The Captain Jona�an was kept. I informed General Manager Jasmine D. Ready that a Board of Health meeting would be scheduled for August 20, 2007 at 3:U0 p.m. at the Ya3mouth Town Hall in the Hearing Room. You or a repre�e�tive mast be present at this meeting. � ' If your motel permit is not granted, you will need to contact the Building Commissioner/Zoning Inspector for a determina,tion on youc condominium Board of Appeals decision or for future zoning use as aparlme�ts.
