F,x[. 241 — Pax (SOS) 398-2365 BOARD OF HEALTH August 26, 2002 Meshwa Corporation d/b/a Best Inn Suites Attn: David Patel, Manager& C.P.O. 69 Route 28 West Yarmouth, MA 02673 Re: Swimming Pools and Whirlpool Violations Best Inn Suites, 69 Route 28,West Yarmouth Dear Mr. Patel, The following chronology of events regarding the pools (indoor and outdoor) and indoor whirlpool located at Best Inn Suites, 69 Route 28, West Yarmouth, is being provided to you, as manager and Certified Pool Operator(C.P.O.)of Best Inn Suites: May 15,2002 Whirlpool chlorine registered zero (0), pH 8.0. Flowmeters needed for whirlpool and indoor swimming pool. Whirlpool needed automated chlorina.tion. May 23,2002 Received notice from Envirotech: Indoor pool Bacteria Report failed. Closed indoor pool. May 31,2002 Opened indoor pool. Bottom seen but still slightly"fuzzy." Clarity needed improvement. July 2,2002 Outside pool needed Shepherd's Crook. Turnover rate of flowmeter too low. Total alkalinity too low(40ppm); chlorine level zero (0). Outdoor pool closed. July 8,2002 Outdoor pool opened. C.P.O. forgot to turn on second sand filter. August 21,2002 Outdoor pool, indoor pool and whirlpool closed. Outdoor la.tch broken; door not self-closing. Shepherd's Crook not attached to Shepherd's Pole. Outdoor pool's water green; chlorine level zero (0). Indoor pool very fuzzy; could not see bottom; chlorine level zero (0). Woman with daughter swimming in pool at the time. Informed them the Pool was closed and they could not stay in pool area. Whirlpool chlorine level zero (0); still has no automated chlorination/bromination. Ring buoy for inside pool lacking rope. Water testing log inaccessible (locked in office). 1 �� Printed on ( Recycled L .y Paper � � • ' ; August 25,2002 (Saturday) Although outdoor pool was closed by the Health Department on August 21, 2002, observed four (4) men, three (3) women and one (1) child swimming in pool. Although indoor pool was closed by the Hea�th Department on August 21, 2002, observed one (1) woman, one (1)young girl in pool azea. August 26,20Q2 Motel Manager Vandana and ma.intenance person Danny Patel had no knowledge of the pool status when asked. The outdoor and indoor pools were not locked closed as required by the Health Department on August 21, 2002. You have violated the following Regulations of 105 CMR 435.000 Minimum Standards for Swimming Pools, State Cade, Cha.pter V: 4 5.3 p6(4} No automated chlorinator/brominator for whirlpooL 435.21(5�- Pool water testing log was inaccessible to Health Inspector. 435.24- Lack of safety equipment,a 56epherd's Crook. 435.29(1)(2)(31(4)- Proper sanitation was lacking in the pool, pH and Total Alkatinity were out of . range. 435.31- Unabte to see the bottom of the poot; water clarity was unacceptable. , 435.35- ' Re-opening a pool without approvat of the Yarmouth Health Department ! The swimming pools and whirlpool have been closed off and on during the summer season by ' the Yarmouth Health Department. ', You are hereby ordered to attend the Board of Health Meeting on Seatember 9. 2002 at ' 4:15 a.m. regarding your indoor and oatdoor pools and whirlpool. The above violations will be addressed at this meeting. Please bring all Pool Water Tes�ing Records, e.g. the Pool Log as well as all Pool Maintenance Records for tlus yeaz. Please bring your copies of the Pool Inspection Reports from this yeaz to better understand the events that ha.ve precipitated this hearing. The outdoor and indoor pool, along with the whirlpool cannot be reopened until in compliance with the State and local pool regulations, and inspected by the Health Department. Please notify the Health Department twenty-four(24)hours prior to the pool inspections. You were notified by a letter from this department on August 22, 2002 that the quart�rly bacterioiogical testing, including testing for pseudomonas, was due to be submitted by August 27, 2002. The results for the indoor and outdoor pools, along with the whirlpool, must be submitted prior to this department opening any ofthe pools. 2 � � , . � ; . � j � i � The Health Department is also aware of a complaint regarding overflowing sewage on August 6, �j 2002. You closed rooms 71, 72, 73, 51, S2, and 53 until the septic system is repaired per engineered plans. �� The dumpster area was cluttered with items (mattresses, wood, plumbing material, etc.) and needs to be removed, and the area cleaned.
