This was based on the review of the hotel properties, dated March l 1, 2016, submitted to the Health Department by Brainsky Levinson, LLC,Attorneys and Counselors at Law. (You were informed of this determination previously.} The Cape Cod Vacation Condos property would be grandfathered for a septic flow of 63 bedrooms only. As the property is located within the Aquifer Protection District (APD) and Zone II of the Town of Barnstable drinking water wells,no additional septic flow would be approved. If the motel is to be razed and replaced, the septic flow would be grandfathered for 63 motel units only. The grandfathered septic flow is based on current State Title 5 and Yarmouth Board of Health Regulations. Any future change in septic regulations may affect septic flows on the property.
