" Dear Mr. Rashad:

On April 1,2016 Philip Renaud, Health Inspector,the Yarmouth Police Department and I conducted a Retail Tobacco
Investigation of your retail store. We found approximately 700 flavored tobacco products in your store.The flavored
; tobacco was found in two drawers behind the counter,a drawer at bottom of tobacco cabinet, and in two boxes in the
' walk-in cooler.
; You are in violation of the Board of Health Tobacco Control Regulation Section G which prohibits the sale of flavored
tobacco.You are hereby ordered to pay a fine of$100.00(second offense).The first ofFense was October 29,2015.At
which time the Board of Health acknowledged the violation and issued a warning.You are also ordered to appear before
the Board of Health at its meeting on May 9,2016,after providing you this notice and an opportunity to be heard,where
the Board will hold a hearing to address whether to suspend or revoke your tobacco sales permit as allowed by the
Board of Health Tobacco Control Regulation Section Q-(1D)for,egregious violations of the Tobacco Regulation.
� You must appear at a Board of Health hearing scheduled for Monday, May 9,2016 at S:OOp.m.,at Yarmouth Town Hall
; Hearing Room.

IIn July 2014 you were informed by a letter and visit by Health Department staff of the new Board of Health Regulation
� prohibiting the sale of tobacco products to individuals under the age of 21, prohibiting the sale of flavored tobacco
i products and self-service displays.
Also in November of 2015 you were provided an update of tobacco information which included mention of prohibition of
� sale of flavored tobacco.
