This letter is to inform you tha.t the Cape Cod Tobacco Control Program,in colla.boration with the Yarmouth
Health Department,has recently completed a compliance check to determine if minors(anyone under the age
, of 18)could purchase tobacco products from your store.
� Minors were able to purchase tobacco in your estabGshment during a compGance check conducted
� on the morning of December 18, 2003. (Time - 10:00 a.m.; Employee was a female teen with short
dark hair.)

� Minors were sent into forty(40) Yarmouth establishments licensed to sell cigarettes to attempt purchases.
� If the clerk asked the minors their age or if the tobacco was for them,the minors told the truth. It is against
� Massachusetts law and the Yarmouth Board of Health regulation for anyone to sell tobacco products to
� people under the age of eighteen.
As this is your store's first violation in the last four compliance checks,this letter is to serve as a Warning.
A Board of Health hearing has been scheduled for Monday, January 26, 2003, at 3:45 p.m. at the
Yarmouth Town Ha11 Hearing Room. You or a representative must appear at this hearing. At this
hearing you must inform the Board of what steps you have taken to prevent future tobacco sales to minors.
Future violations will result in fines and your requued appearance at a Board of Health hearing,where the
Board will determine if your tobacco license should be suspended, revoked, or other penalties assessed.

11:00 a.m.
