{ Dear Yarmouth Merchant:
The Yarmouth Police Department, in collabor.ation with the Yarmouth Health Department, has
recently completed a compliance check to determine if minors (anyone under the age of 18) could
purchase tobacco products from your store.
Minors were able to purchase tobacco in your store during a compliance check on the evening
of Apri18, 1999.
Minors were sent irrto thirty-seven(37)Yazmouth establishmerrts licensed to sell cigarettes to attempt
purchases. If the clerk asked the minors their age or if the tobacco was for them, the minors told the
truth. It is against Massachusetts law and the Yarmouth Boazd of Health regulation for anyone to
sell tobacco products to people under the age of eighteen.
As your store is in violation of Massachusetts law and the Yarmouth Board of Health regulation on
Tobacco Control, a Board of Health hearing has been scheduled for Monday, Apri126, 1999 at
3:15 p.m. at the Yarmouth Town Hall Hearing Room.
At this hearing the Board of Health will determine what penalty will be assessed for violation of the
Board of Health Tobacco Control Regulation. The Board of Hea1th will determine if the Tobacco
iLicense should be suspended, revoked, a fine issued, or other penalties assessed. You or a
i representative must appear at this hearing.

� For your information, minors were successful in purchasing ci�arettes at five out of thirty-seven
� Yarmouth establishments which sell tobacco products.
