Dear Mr.Dobson,
The Yarmouth Health Department has noticed over the years the increase in scope of seledion of food
items that CVS stores ofer in Yarmouth.CVS stores originally were permitted for"Retaii Food Service°
(RFS) with restridions of°Pre-padcaged food only- chips, candy, chewing gum". The cumeM permit
reflects these same restrictions, yet items such as milk, ice cream, canned goods, and other items are
displayed on the shelves and in refrigeration for sale.
Town o#Yarmouth Supplemerrtal Food Service Regulations to 105 CMR 590.00 states that"Floors
and floor coverings of all food preparation food storage, warewashing areas, walk-in
refrigerators, dressing rooms, locker rooms, toilet rooms and vestibules, shall be constructed
of smoath, nonabsorbert, light colored, durable, easily washable material." The floors in the
food display areas currently have capeting in frorrt of them;this is not"non-absorberrt material".
Please corrtad me at your earliest convenience to arrange an Administrative Hearing with the Health
Dirrecor, Bruce Murphy, and myself. At this meeting we will explore all options regarding your RFS
permits for the tro CVS stores in Yarmouth.Thank you for your timely aiterrtion to this maiter.
If you have any questionsgarcting this or any matter conceming the Health Departmerrt, please do
not hesitate to call this office at(508)39&2231 ext.241.
Sincerely,
David D.Flaherty Jr.
