Dear Mr. Hynes:
In your letter dated December 23, 2010,you explain that the number of rooms you are able to
operate at what is now the Gull Wing(and will become the Irish Village) will be reduced from
134 to 114 due to DEP septic reguIations. You are appealing this decision with ihe hope to be
able to continue operating 134 rooms. In this circumstance, the Town agrees not to reduce your
allocation of motei rooms pursuant to applicable bylaws for a nine month period ending
September 30, 2011,pending the outcame of your negotiations with the Massachusetts
Department of Environmental Protection (DEP). This agreement does not change the number of
rooms permitted by the Health Department. I would ask that you keep us informed relative to
your negotiations with the DEP.
In the coming months,the Town will be developing guidelines as to how allocation of motel
rooms will be managed with respect to the cap set by the bylaw. In the interim, I see no reason
that we should not approve your request to retain rights to the number of motel rooms that have
historically operated an the site pending a final decision from the DEP on the number of rooms
that will be authorized under applicable wastewater regulations.
