't7 (�- B O A R D O F H E A L T H August 26, 1999 � Cape Cod Irish Village 512 Main Street West Yannouth, MA 02673 I Re: Tobacco Sa1es Compliance Check � " ; Location: 512 Main Street, West Yarmouth, MA 02673 I � Dear Yarmouth Merchant: , ' The Cape Cod Tobacco Control Program, in collaboration with the Yarmouth Health Department, has recently completed a compliance check to deternune if minors (anyone under the age of 18) could purchase tobacco products from your store. Minors were able to purchase tobacco in your storc during a compliance check on the afternoon of August 23, 1999. (Time- 1:25 p.m.; Employee was female, approaimately 18 years of age) � � Minors were sent into thiity (30) Yarmouth establishments licensed to sell cigarettes to attempt purchases. If the clerk asked the muiors their age or if the tobacco was for them, the minors told the txuth. It is against Massachusetts law and the Yarmouth Board of Health regulation for anyone to sell tobacco products to people under the age of eighteea As your store is in violation of Massachusetts law and the Yarmouth Board of Health regulation on , Tobacco Control,this letter is to serve as a First Warning Notice. Future violations will result in fines and your required appearance at a Board of Health heanng, where the Boazd will determine if your tobacco license should be suspended, revoked, restricted or other penalties assessed. If you would like to contest this waming, a Board of Health hearing has been scheduled for Monday, Se tember 13, 1999 at 3:15 p.m. at the Yazmouth Town Hall Hearing Room. P For your information,minors were successful in pwchasing cigarettes at four out of thirty Yarmouth establishments which sell tobacco products.
