The COMMISSION orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol- lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent. the conditions shall control. General Conditions 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas- ures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de- bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor index under the name of the owner of the land upon which the prcoosed work is to be done. In the case of registered land. the Final Order small also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposes work is to be done. The recording information shall be submitted to the COMMIS_ ICON on the for-i at the end of this C,-cer prior tc-cmmencement of the work. 9. These orders of conditions shall apply to any successor in interest or successor in control. 16. The floats are to be removed seasonally. 17. Boats shall be docked at the floats only. 18. Four cement blocks shall be placed at each corner of the float, in order to prevent the float from touching the bottom at low tide. 19. The proposed patio shall never be closed in (i.e. built upon or enclosed). 20. There shall be no dredging in connection with this.project. 21. The pilings shall be hammered driven. 22. All cut up ends and debris shall be cleaned up at the end of each work day and not allowed to enter the waterway. 23. Excess material, if any, excavated from the area of the building foundation and septic system, not required for backfill and grading, shall be disposed of only at locations approved by the Conservation Administrator. 24. Any fill required, (See General Order #6 in Order of Conditions)shall be of clean sand and contain nb material over 12 inches in diameter. 25. A hay bale dike shall be staked in place as shown on the plan, before any work begins on the project. 26. This dike shall constitute a work limit line. No work of any kind wil be permitted on the wetland side of this line. 27. Any area proposed for removal of vegetation for a period of more than seven days, shall be mulched or otherwise treated to prevent erosion. 28. The deck shall not be closed in without a filing of either a Notice of TntPnt or a Reauest for Determination of Applicability. 29. The applicant shall be responsible for having a copy of the Orders of Conditions on the job site at all times. Failure to do so could possibly result in a revocation of the Order, or a fine, or both. 30. The Conservation Commission, its agents or assigns, shall have the express right of entry upon the property for the purposes of establishing compliance to the conditions stated herein. 31. Upon completion of the project a Certificate of Compliance shall be requested. This Order shall be considered incomplete until the Certificate of Compliance is recorded. ENGINEERING -SURVEYING -PLANNING I NARRATIVE NA-1 The area subject to this Notice is land in and adjacent to Bass River in South Yarmouth, MA. Please see Locus Map (Figure 1) for exact location. The site is a residential parcel with an existing dwelling and existing timber pile supported pier, ramp and float. To the river side of the dwelling the land is very low (el = 3-6 NGVD), and flat, resembling a beach plain with clean fine sand sparsely vegetated with American beach grass. This low exposed face of the dwelling received a dose of flooded Bass River tidal water during recent weather related coastal floods. The pier is of a typical timber construction located predominantly in the intertidal zone. A ramp and float provide additional length to reach somewhat navigable water at low tide. The tidal flat in this region is considered a shellfish resource. The river bottom is shallow and silty with pockets of eel grass in locations. The project is two fold: 1. Earth fill is proposed for the area east of and adjacent to the dwelling. See plan for proposed elevation contours. The fill is intended to significantly protect the cellar area in the event of a coastal flood event of any significant magnitude. Closing in the cellar window and walkout openings with mortared and sealed joints and creating a vegetated bank will blend in very well with the surrounding area, furthering the interests of flood protection for the subject property and those adjacent. The coastal flood plain is not necessarily significantly impacted by a volume of fill. The subject flood zone is an "A" zone not a zone of velocity flood water where scour may be of greater concern. No compensatory volume need be created, as we are dealing with a coastal flood zone. The fill project shall not affect utilities as there are none in the project area. The subsurface sewage disposal system is on th.e street side of the dwelling. All construction access to deposit and landscape the proposed ' filled bank area shall be via the route shown on the plan in conformance with staked work limits. The toe of the proposed slope shall be temporarily stabilized with staked hay bales ' until such time as the proposed bank has been vegetated in accordance with the site plan. Snow fencing is recommended to control foot traffic and reduce wind velocity near the slope. E--=--`-`SCH0FIEI.D BROTHERS,INC. ENGINEERING -SURVEYING -PLANNING Additional measures for stabilization and mitigation also ' appear on the site plan: . Downspouts and drywells or gravel drains shall be provided to ' contain roof runoff. . No chemical fertilizer shall be used to supplement plantings. . No construction activity shall take place beyond the staked ' work limit or silt fence except that necessary for pier construction and maintenance. . Planting may take place beyond the work limit. . Snow fence shall be staked in place along the toe of slope ' during the off season as a minimum. 2. The Pier Extension Due to long term shoaling of this reach of the river, depth of water at low tide is a diminishing quantity. The applicant seeks ' to extend the permanent portion of the existing pier approximately 12 feet for a total length of 60 feet +/-. An additional 8'W x 16'L float shall be connected to the existing 8'W x 20'L float to provide access to adequate navigable water. See Plan for details. The pier, damaged in Hurricane Bob, requires complete reconstruction. In so doing, the total number of support pilings ' shall remain the same with the extension. There is no salt marsh vegetation near the work area associated ' with the pier or any aspect of the project. All accessible pier pilings shall be hammer driven where possible. All timber shall be wolmanized for marine application. All ' hardware shall be steel, hot dip galvanized. During the off season, the existing float shall be stored at an upland site. ' The project, as proposed, serves to further the interests of the MGL Chapter 131 and the Yarmouth Wetland Bylaw. The fill bank furthers the interests of storm damage prevention via a "soft solution"; the proposed pier extension and reconstruction reduces piling number and provides improved navigability at the site where the riparian access has been well established.
