Yarmouth, MA 02664 ' Dear Mr. Heufelder: � i It has been some time since you inspected our house at 92 Cottage Drive in West Yarmouth and considerably longer since we submitted to your office a check for a ( license to rent. If you are not planning to send our license, we would appreciate the ' return of our check since we may as well accummulate interest on it as to have the ' Town of Yarmouth do so. Frankly, we can't understand why there is a delay. If you are waiting for the replacement of our septic system, then we feel you are wrong. In its present ' condition there is no problem with the cesspool as long as it is emptied regularly. ' In f act, a family of 4 lived in the house for 8 years with the present condition of ' the cesspool and apparently prevented any problems by having it emptied out monthly. Since we do not use the house to that extent (it has not even been occupied in months) and never have more than 4 people and rarely more than 2 in it, we certainly should ', have no more, and probably less, trouble than they did. If you had not overheard our conversation with Bruce Murphy, you would not have discovered any cesspool problem , during your inspection. Thus, you and others at the Board of Health must remember that we asked permission to replace the cesspool -- we were not ordered to do so. ; Apparently that was a mistake on our part since others at the Board of Health seem determined to prevent our occupancy and use of our property. According to our lawyer, ' that property is protected by a grandfather clause and therefore a septic system must ' be approved and there should not have been the round-around that we have been getting about it. In f act, he states that Bruce Murphy was required by law to have completed the approval process within a 90 day period. It has already exceeded that time period I and we are beginning to feel that we are being victimized and are considering a law suit. I'm sorry for the bitterness and anger in this letter and for the route we apparently will have to take, especially after the pleasant association we had with you at our house on the Cape when you came to inspect it for the license. However, we feel we are being forced to respond this way by your office and the unreasonable handling of our situation.
