� The Yari�uth Boa.rd of Health, having received your application for a Variance
i fran the provisions of Rec�ulation�_p 2� � )&�S p��4) of Title 5 of the
' + State Environmental Code and/or frcan the Tawn of Yarmouth Amenc�nents, Section
; = 3. 7 , for a Subsurface Sewage Disposal Syst�n and, having deter-
i . mined that strict enforcement of these regulations in this instance would do
manifest injustice and, further, that your requested variance does not conflict
with the spirit of the State Environmental Code nor the Tawn of Yarmouth Amend-
ments, has hereby granted the variance which shall beccane effective on the a-
bove indicated date, thus fulfilling the 30-day filing notification require-
ments of the Department of �vironmental Quality Engineerinq, The variance(s) ,
as granted at-the Board of Health Meetirig on J u 1 y 2, 19 9 0 , axe
as foilows:
For construction of a new house & septic system, per engineered
plans by Down Cape Engineering Inc. , dated revised 7/20/90:
1 ) Title 5-15 ,02( 7) : Variance from the required 25 ' removal of
unsuitable soil around septic system - 10 '
removal proposed 15 ' variance.
2 ) Title 5-14.03 (4) : Percolation test not directly under
proposed septic system.
3) Town Amendments 3. 7:Primary leaching less than the required
100 ' to wetlands, 97 ' proposed - 3 '
variance.
You are further advised that no work shall be cam�nced under this variance un-
til the elapse of the thirty day filing period and that the variance granted
herein sha11 expire in nine�, (90) da.ys fran the effective date. F�irt-hern�ore,
that all w�rk so authorized by said variance shall be ccanpleted prior to, or on,
the date of expiration.
In g�'antin_q this variance the Tawn of Yarnlouth shall not be held responsible
for any water damaq to the founda.tion, septic systean nor adjoining lots.
