Lawton, �r. , Executive Secretary From: Bruce f�lurnhy, Health Officer�/�'� Re: Resoonse to Memo of 1/13/81; 21 Old Salt Lane A Mary Kelly, owner of Lot 21, Old Salt Lane, wrote Mr. Arthur Luke the letter you enclosed with your memo of �anuary 13, 1981. In I�er letter she raised the following questions; ' (1) Because of strict health laws in the town, the lot must pass a nerco- lation test before the buyer would ourchase it. This was stated to her by th� realtor, Mrs. Stone. h1y comment to the above is, that this is untrue. Any land can be sold or our- chased without a deen or oercolation test first being conducted, and also, with- out arior aonroval from this deoartment. However, many realtors have a state- ment included in the buyers' ourchase and sales agreement that states the lot . must first nass a aercolation test and be able to obtain the necessary building �ermits. Obviously this was not done in 1967 when they vurchased the lot. This deoartment has. received a com�laint from another land buyer regarding the realtor, Mrs. Stone. In this instance, the buyer ourchased a lot that; when , tested, had clay, _water, and was near wetlands. Without furth�r testing, appli- ' � cations to Conservation and Board of Health for variances,etc., the lot is un- ° buildable at this time. Mrs. Stone would not refund the buyer's deqosit until the oerson exhausted all avenues in trying to obtain the neeessary building oer- mit. The buyer thought this very unreasonable, as the lot does aooear marginal. � The buyer qresently has an attorney, checking to see if the agreement to aur- chase can be anulled. - (2) The lot did not nass oercolation tests. ��ly comment to this is; two test holes were dug, with clay found down to a deoth of ten (10' ) feet. No subsurf�ce sewage system can be installed unless there is a four (4' ) foot layer of aervious material, which these two_tests did ', not reveal. It is oossible that further testing on this lot might reveal a dif- ferent material. However, the test would qossibly be conducted closer to the wetlands. • , As for tax abatements on lots that fail percolation. tests, this deoartment has ' no authority nor Jurisdiction, over the tax-setting structure. I. have mentioned the above problem to Bill Hendrickson and Ed Donnolly. in the qast. Perhaqs a � oolicy could be established for unbuildable land, i.e., clay, high water, �vet- ' lands, etc. I would suggest that you check with hir. Hendrickson and Mr. Donnolly. • I will offer assistance where needed. (3) Town sewers in the area. My comment: Perhaps in the future, but no olans for such at this time. " '�-- - Page 2. , (4) Price of testing. $125.00. My comment: This deoartment does not set the fee's charged by the Engineering firms. A $10.00 fee is charged by this deoartment_for qercolation tests which covers the inspection by the health agent to observe the field work, and to re- cord the test results. I personally feel that, these_peoole are 'stuck' with an unbuildable lot, through their own fault, i.e., not having the lot tested back in 1967, to the oresent. That they are now expecting the town to correct this problem and make the lot a buildable one. . The matter of reduced taxes for unbuildable lots, though. should be looked into.
