Minors were able to purchase tobacco in your store during a compliance check on the morning of December 14,2005. (Time— 10:30 a.m.; Employee was an adutt female.) Minors were sent into thirly-seven(37)armouth establishments licensed to sell cigarettes to attempt purchases. If the clerk asked the muiors their age or if the tobacco was for them, the minors told the truth. It is against Massachusetts law and the Yarmouth Board of Health regulation for anyone to sell tobacco products to people under the age of eighteen. As this is your stare's first violation in the last four compliance checks, this letter is to serve as a Warning. At this hearing you must inform the Board of what steps you have taken to prevent future tobacco sales to minors. Future violations will result in fines and your required appearance at a Board of Health hearing, where the Board will determine if your tobacco license should be suspended, revoked, or other penalties assessed. I For your information, minors were successful in purchasing cigaxettes at four out of thrity-seven ; Yarmouth establishments which sell tobacco products. If you have any questions or comments regarding the above matter, I can be reached at the Health Department at(508)398-2231,e.241,Monday through Friday, during the office hours of 9:00 a.m. ! to 11:00 a.m. S' erely, ; Bruce G.
