On August 20, 200�a meeting to review the use and status ar the Capt.�in Jonathan Motel was �'
held at Yarmouth Town Hall by the Yarmouth Board of Health. At this meeting it was requested '
that we, as diligent owners, reiterate the position that aur facility is not and cannot be used as '

transient guests as defined by the Town of Yarmouth,the definition of which reads: !

Transient Occupancy: For purposes of the limitations of�.Vlotel or Hotel use, Transient �
occupancy shall be limited to the temporary and short term occupancy, ordinarily and
custamarily associated with the motel and hotel use. Transient occupants must have and
be able to demonstrate that they maintain a principal place of residence elsewhere.
Transient occupancy shall generally refer to continuous occupancy of not more than
thirly (30) days, and an aggregate of not more than ninety (90) days within any suc (6)
month period. Use of a guest unit as a residence or dwelling unit shall not be considered
transient. Qccupancy that is subject tQ the collection of Room Qecupancy Excise, as �
defined in M.G.L. c. 64G or 83o CMR 64G, as amended shall generaIly be considered �
transieat. '
Realizing that the Captain Jonathan Motel currently offers lon,�-term stays to our '
guests who are worldng in the area, the Board of Health has tent�tively given
limited authorizadon to continue this use thraugh 200�and into the early months '
of 200$, provfided that the current guests, once their individual work and projects i
in this area have been completed, depart in the fashion of a typical hotel guest, and ;
any return visits must be in compliance with the terms of our motel license,which is �
limit�d to transient occupancy only. �
As a condition of this authorization, the �oard of�ealth has required us #o establish departure �
dates for all of our guests as we transition to a seasonal motel property. Please notify the desk as
soon as possible as to your anticipated departure date. Realizing that the requirements and
timetables of work assignments can change, we understand that the actual departure date may I
differ slightly from the estimated departure date, but we ask that you provide us with the most �
accurate informadon that you have available. � �'
