This was in response to her January 27, 1999 ca11 to Yarmauth Lodge#2270. It appears to me that she is confused as to what happened during her visit. Kelda Welsh states that I said I was exempt form this law. In fact when she was here talking to me I said that I thought that Yarmouth Lodge#2270 was exempt from this regulation as we are not open to the general public. When the regulation to prohibit cigarette vending machines was enacted Yarmouth Lodge#2270 and the Town Of�armouth discussed our status and it was decided at that time we were exempt from this regulation. I asked that she confer with you on the purpose and intent of this regulation in regards to our establishment, and get back to me. I fully expected a telephone call from you as to our status and if we must conform to this regulation. I think the manner in which Kelda Welsh is dealing with this matter is preemptive and unwananted. Her manner is certainly not consistent with other officials of the Town of Yarmouth. Yarmouth Lodge#2270 has not refused to comply with the regulations of the TQwn of Yarmouth,but asks that since we are a private club are we required to adhere to a regulation that is for an establishment that is open to the general public? Has the existing regulation banning cigarette vending machines changed, or is Kelda Welsh interpreting it differently2 I would ' o ve this matter with you as soon as possible, and do not think that necessi ates g that Kelda Welsh has scheduled. Box 186 South Yarmouth, MA 02664 Dear Mr. Sullivan: I am writing in regard to the Yannouth Moose Lodge at 834 Route 28, SouthYarmouth, Massachusetts. On January 27, 1999, I spoke with you about the Board of Health regulation prohibiting cigarette vending machines. At which time you stated that you were exempt from this law due to the fact tha.t you are not opened to the public. Section V of the Board of Health Tobacco Control Regulation states: No vending machines for dispensing cigarettes or other tobacco products are allowed in the Town of Yarmouth. The Loyal Order of Moose is currently issued food service, common victuallers and alcohol pernuts from the Town of Yarmouth As your business is in violation of the regulation, a Board of Health hearing has been scheduled for Monday, February 22, 1999, at 3:30 p.m. at the Yarmouth Town Hall Hearing Room. You or a representative of the Yarmouth Moose Lodge must appear at this hearing. The Board of Health will review the above viola.tion and determine if any fines will be imposed. If you should have any questions or comments relative to this matter, please contact me at the Health Office. Kelda Welsh was working under my direction in enforcing the established Town regulation regazding tobacco and scheduling you for a Board of Health hearing. In your letter you stated that you discussed this issue with the Town of Yarmouth and it was decided at tha.t time you were exempt from this regulation. The Board of Health has never exempted you or any other facility for vending machines.. The Board of Health Hearing scheduled for Monday, February 22, 1999, at 3:30 p.m, is to discuss this issue further at which time a decision will be made regarding your vending machine. If you should have any questions or comments relative to this matter, please contact me at the Health Office.
