At the meeting the Board voted»n�nimously to grant a variance to the regulation which will expire on December 31, 2001 with the following conditions: 1. Controlled admission of inembers to the building by individual key or steward. The door is always locked and only members ha.ve keys. 2. A nonmember may only visit the lodge by invitation and may only ha.ve two visits. The guest book must be maintained and monitored. 3. Only one pool table and two video games. (This is the current number on site.) 4. No Keno allowed. (There is currently no Keno within the lodge.) 5. Entertainment by band or DJ shall not be more than ten times per month. 6. There shall be no more than fi$een functions per month. When the function hall is used, the hall shall be nonsmoking. (The door between the function hall and the social quarters shall remain closed.) 7. When the dart league uses the lodge function hall, the function hall shall be smoke free. There is 1 pool table and 2 video games. 2. No Keno is allowed. 3. Entertainment has been limited to 10 times per month. 4. All employees are members of the Lodge, no changes have occurred from the previous submitted employee list 5. The Cape Cod Dart League matches have been held in the function halt, and are non-smoking. 6. Meal functions have been limited to 15 per month. 7. Non member guests are limited to a maximum of 2 visits. ��-� � � � Enclosed are the monthly calendar of events that has transpired since the variance for smoking was issued. I do not have a calendar of events for the year 2001 established, but it will basically follow the format as shown on the enclosed calendars. Yarmouth Lodge#2270 has abided by all of the agreed conditions set forth in the variance that was granted on March 27, 2000, and I am requesting that the smoking variance be allowed to continue. '�+l — F,u (�Oh) i9�-_'3(i� B O A R D O F H E A L T H March 28, 2000 Donald Sullivan, Administrator Loya1 Order of Moose Lodge#2270 PO Box 186 South Yarmouth MA 02664 Dear pon: ,, On March 27, 2000, you appeared at the Board of Health meeting to request a variance from the Board of Health regulation that prohibits smoking in restaurants and bars. You previously had submitted a letter dated February 20, 2000 that outlined the operation of the Moose lodge. You also � submitted a letter dated Mazch 23, 2000 outlining the Moose lodge purpose, operation, specifics, and suggestions. Also enclosed was letter from the IRS dated May 29, 1940 stating the taa�exempt status and Articles of Organization for the corporation as submitted to the Commonwealth of Massachusetts. You informed the Board that the Moose is a private, nonprofit fraternal organization. The Moose lodge is owned, maintained, operated and governed by its members. Membership follows a strict and timely procedure that involves sponsorship, review of applications, acceptance by membership, orientation, and enrollment. Once granted membership, a member has yearly dues to maintain his good standing in the fraternity. A member ma.y bring qualified guests into the lodge for the purpose of possibly joining the fraternity. The prospective member may only enter for orientation and enrollment. The lodge employs stewards to work within the building, and all the stewards are members of the lodge. The function hall will not be rented to nonmembers. There is currently no Keno within the lodge as the state will only grant a Keno license to public facilities. The Board expressed concern regazding the lodge operation being modified into more of a restaurant type of business as this would then provide an unequal playing field with other town establishments. A concern was expressed about the operation of the lodge being modified into a drink and sandwich or dinner crowd. You informed the Board that this was not the lodge's intent. After further discussion by the Board and yourself, the Board moved to grant a variance from the Board's restaurant and bar smoking regulation based on the following conditions: - 1.
