Lawton,Jr ..�._,,....�_.__ � , - Town Administrator SUBJECT: Moose Lodge DATE: March 13, 2002 The Board of Selectmen have asked if you could confirm that the Board of Health has voted to ban smoking at the Moose Lodge, starting July 1, 2002. In addition, it was reported to a member of the Boazd of Selectmen that one reason for the vote of the Board of Health was that all patrons of the Moose Lodge had to go through the bar area, the smoking area,in order to get to the restaurant and other areas of the club. It is the understanding of one member of the Board of Selectmen that there are several entrances that could be used,which would avoid the smoking area. Murphy, MPH, Director of Health '�J Date: March 14, 2002 � Subject: Moose Lodge At the Board of Health meeting on December 17, 2001 (copy of Miriutes enclosed),the Board held a hearing in regards to the Board of Health Tobacco Control Regulation and a previous variance to allow smoking within the Moose Lodge which expired December 31,2001. The l�alth concern was for Moose members, family members, and children passing through smoking areas to access entertainmern and dining. There was also a concern for the heahh of the employees. The Board aLso had previously informed the public and business community about providing a level playing field when the Board prolubited smoking in restaurants and bars in 2000. The Board had received several complaints that the Boazd was not allowing a level playing field with other restaurants and�rs tha.t were complying with the Board of Health Tobacco Regulation. The Moose serves lunch,and offers monthly activities{copy of monthly schedule for the year enclosed). T'he Board voted that on January 2, 2UO2, the Lodge must be non-smoking. At the Board of Health meeting on January 14, 2002 (copy of Minutes enclosed), the Board again held a public hearing to review the Tobacco Control Regulation and the Moose Lodge. After discussion with the Boazd of Health and the Moose Lodge representative,the Board voted to e�end the variance to allow smoking until July 7, 2002. The Board had previously allowed restaurants and bars approximately a forty-five day grace period prior to the implementation of the tobacco regulations in 2000, however, there was prior notice to restaurants and bars regarding the pending Boazd of Health hearings. This�w date for the Moose Lodge would give them a similar lead tirne as was for past restaurant and bar establishments, and allow time to build an outside deck and awning if they wished. I have also enclosed a January 17, 2002 article from The Register in regards to "Yarmouth's last holdout loses right to smoke." A$er the recent two Board of Health hearings, I do not believe having people use other entrances would change the Board of Health decision, as the Board is also concerned with the health of the employees and with providing a level playing field for restaurants and bars.
