NOTICE OF VIOLATION

RE: Inspection Date 02/18/09 — 02/18/10 Fee: $100.00
Dear Sirs:
Pursuant to the provisions of 780 CMR (NIA State Building Code) Table 106 this department has on January 20,
2009 mailed you notifications of the required annual inspections and provided you with the pertinent application. Our
records indicate your Certificate of Inspection expired on February 18, 2009. You are no longer in possession of a valid
Certificate. 780 CMR Section 106.5 entitled Inspection & Certification of Specified Use Groups states that "A building
or structure shall not be occupied or continued to be occupied without the posting of a valid certificate of inspection
where required by Table 106." However, as of this date you have failed to complete said application, pay the applicable
fee and schedule the required inspection.
Accordingly, you are hereby notified as required by 780 CMR Section 118.2 -Notice of Violation that you are in violation
of the aforementioned code provision for failure to have a current Certificate of Inspection.
780 CMR 106.5 Inspection and Certification of Specified Use Groups: The building official shall periodically
inspect and certify buildings and structures or parts thereof in accordance with Table 106. A building or
structure shall not be occupied or continue to be occupied without the posting of a valid certificate of inspection
where required by Table 106. A certificate of inspection as specif ed in 780 CAM 106.5 shall not be issued until
an inspection is made certifying that the building or structure or parts thereof complies with all the applicable
requirements of 780 CAM, and until the fee, if a fee is required by the municipality, is paid...
Should you fail to remedy this situation within ten (10) days of receipt of this notice, this department will take appropriate
legal measures, which may include a license hearing before the licensing authority.
Finally, 780 CMR Section 118.4 Violation Penalties provides for up to a $1,000 per day fine, with each day constituting a
separate violation. Additionally, you are subject to MA Building Code Violation Notice tickets under MA General Law
148a, which can be issued for up to $1,000 per day, with each day constituting a separate violation.
