DECISION
Procedural History
This appeal ("Appeal") is before the Massachusetts Building Code Appeals Board
("BCAB") as a result of an application filed pursuant to G.L. c. 143, § 100 ("Application") on June
26, 2018. Appellant William Jackson sought relief from 780 CMR R301.2.1.2 (8th Edition of 780
CMR)to be allowed to comply with 780 CMR R202 and R301.2.1.2 (9th Edition of 780 CMR)with
respect to new construction of a single-family dwelling located at 4 Jessies Lane,South
Yarmouth, MA. •
On or about, May 16, 2018, Local Inspector Tim Sears,for the Town of Yarmouth, issued
a letter,which determined that he did not have the authority to waive the requirement for
opening protection in a single family dwelling required by 780 CMR R301.2.1.2 (8th Edition).
(Exhibit 1A).

Notice of the hearing was issued to the parties. The hearing for the Appeal was held on
July 24, 2018. All interested parties were provided with an opportunity to testify and present
evidence to the BCAB. For Appellant:William Jackson. For the BCAB: Harold Learning; Richard
Crowley; H.Jacob Nunnemacher. Patricia Barry, the BCAB's clerk was also present.

Findings and Discussion
Jackson obtained a building permit to construct a six-bedroom, single-family dwelling,
with a detached 2-car garage (with living space) pursuant to the 8th Edition of 780 CMR in June
2015. In May 2017 a temporary certificate of occupancy was issued for the home. During
construction,Jackson was aware of the upcoming changes in the proposed 9th Edition of 780
CMR, which would allow for certain types of doors and windows (with lesser wind-borne debris
resistance than those required by the 8th Edition), and had those types ordered and installed.
There are approximately 84 windows in the home.
The land on which the building was constructed was located in a "wind-borne debris
region" as defined in the 8th.Edition of 780 CMR. As mentioned above, the 9th Edition of 780
CMR changed specifications related to "wind-borne debris region[s]"that existed in the 8th
Edition.
Pursuant to the 8th Edition of 780 CMR,the location of the dwelling in Yarmouth was in
a "wind-borne debris region" because Yarmouth was listed as having a "basic wind speed" of
110 mph. See R202(8th Edition)and Table R301.2(4) Massachusetts Basic Wind Speeds(8th
Edition). "Wind-borne debris region[s]" were defined as "areas within hurricane-prone regions
within one mile of the coastal mean high water line where the basis wind speed is 110 miles per
hour. . . or greater; or where the basic wind speed is equal to or greater than 120 miles per
hour.". 780 CMR R202(8th Edition) (emphasis in original to identify phrase defined in 780 CMR).
Pursuant to the 9th Edition of 780 CMR (which is the 2015 IRC, adopted, incorporated,
and amended by Massachusetts as part of 780 CMR),the definition of"Windborne Debris
Region" is:
Areas within hurricane-prone regions located in
accordance with one of the following:
1. Within one mile (1.61 km) of the coastal mean high water line
where the nominal design wind speed,V asd, is 130 mph (58 m/s) or
greater.
2. In areas where the nominal design wind speed, V asd, is 140 mph
(63.6 m/s)or greater.
NOTE:Values of V ult are found in Table R301.2(4).To convert V ult
to V asd, refer to Table R301.2.1.3. 780 CMR R202(10/20/17
Massachusetts amendment to the 2015 IRC).
The wind speed requirements changed from those in the 2009 IRC to those in the 2015 IRC.
(Research led to the change in wind speeds from the 2009 IRC to the 2015 IRC, which generally
lowered the wind speeds. See, R301.2.1.3 Wind Speed Conversion in "Significant Changes to

the International Residential Code,"2015 Edition, by Stephen A. Van Note and Sandra Hyde,
P.E., International Code Council.) The "basic wind speed"for Yarmouth is now 140 V ult(mph)..
780 CMR Table R301.2(4). The symbol "V ult" means "ultimate design wind speed." The
former"basic wind speed" in the 8th Edition is now referred to as "Vasd"which means, now,
"nominal design wind speed." Table R301.2.1.3 provides wind speed conversions from V ultto
V asd. Under Table R301.2.1.3, a V ult of 140 is the same as a V asd of 108.
Thus,Yarmouth's V asd of 108 is lower than either of the V asd's in the present
definition of"windborne debris region" in the 9th Edition. As a result,the dwelling is no longer
in the "windborne debris region"for purposes of 780 CMR,thus not subject to the
requirements of 780 CMR R301.2.1.2 (9th Edition)for certain types of robust windows and
glazing. The BCAB agreed. The BCAB also acknowledged that the Local Inspector did not
oppose allowing the requested relief. (Exhibit 2).
Conclusion and Order
Based on the evidence and arguments in only this Appeal,the BCAB GRANTED a
variance from R301.2.1.2 (8th Edition)to this specific dwelling.

Please be advised that 780CMR, State Building Code, Section RI 10 provides that "A building or
structure shall not be used or occupied ----until the Building Official has issued a certificate of
occupancy."
Accordingly, please contact this office for a final inspection of the items referenced herein. Upon
completion and approval of same,a full Certificate will be issued. This process must be completed by

As per our phone conversation of this AM,concerning my February 1,2018 letter, please find attached,the Building
Code Board of Appeals variance application and associated instructions. As discussed,the construction in question was
performed under the Eighth Edition Building Code. It is my understanding you wish to file this variance from the
Window Fall Prevention Code Requirement,cited in Sections R612.2-R612.4.1. For you edification, I am also
attaching copies of the Code provisions and Code Commentary.
Finally, as discussed,the Temporary Certificate of Occupancy expired June 31, 2017, Therefore it is imperative that
compliance with these provisions be met or you obtain a variance from the Board. One of these is required, in order
for a Formal Certificate of Occupancy to be issued. This action shall be taken immediately. The implications of not
having the required Certificate were cited in my February 1, 2018 letter.

This to serve as a follow up to my email of February 7, 2018 and my letter of February 1,2018, concerning 4 Jessies Lane
South Yarmouth, Certificate of Occupancy. As per your request I provided you with the Building Code Board of Appeals
application and instructions on February 7. However,as of today, I have not heard from you as to how you intend to
proceed;with either filing for the Variance or complying with the Wind Zone Opening Protection provisions. In either
case, as previously stated you must proceed immediately with one of these measures. Failure to do so will result in
enforcement action which will include the issuance of tickets which'range from $100 for the first offence to $1,500 for
the third and subsequent offences. Each day without a Certificate of Occupancy constitutes a separate violation.

This is to serve as a follow up to my February 1,2018 letter, (copy enclosed)concerning the lack of a
Certificate of Use&Occupancy for the newly constructed single family house at4 Jessies Lane,South
Yarmouth,resulting in the following violation:
VIOLAITON-780CMR, State Building Code, Section 111.1-Use and Occupancy provides that"No
building or structure shall be used or occupied—until the Building Offical has issued a certificate of
occupancy—."
Reasons for Violation:
1. The latest Temporary Certificate of Occupancy expired January 1, 2018 (issued October 6,
2017).
2. Compliance with the high wind zone opening protection provisions have not been complied
with nor have you applied for a variance.
Because it has been almost one year since construction has been completed and three Temporary
Certificates of Occupancy having been issued,it is imperative the opening protection requirements in
a high wind zone be addressed and brought to a conclusion immediately. In the event of an
occurance where an insurance claim would have to be filed,you may have difficulty with your
insurance company without having a lawful Certificate of Occupancy.
Accordingly,you are hereby ordered to take appropriate remedial measures to abate this outstanding
issue within thirty(30)days. Failure to do so will result in appropriate enforcement action,which will
include the issuance of tickets with fines from $100 for the first offense, $500 for the second offense
and$1,500 for the third and subsequent offencses. I consider failure to comply within thirty days as the
first offense and each succeeding thirty day intervals as second and third offenses.

Mr.Jackson:
As per our phone conversation of this AM,concerning my February 1, 2018 letter, please find attached,the Building
Code Board of Appeals variance application and associated instructions. As discussed,the construction in question was
performed under the Eighth Edition Building Code. It is my understanding you wish to file this variance from the
Window Fall Prevention Code Requirement, cited in Sections R612.2-R612.4.1. For you edification, I am also
attaching copies of the Code provisions and Code Commentary.
Finally, as discussed, the Temporary Certificate of Occupancy expired June 31, 2017. Therefore it is imperative that
compliance with these provisions be met or you obtain a variance from the Board. One of these is required, in order
for a Formal Certificate of Occupancy to be issued. This action shall be taken immediately. The implications of not
having the required Certificate were cited in my February 1, 2018 letter.

After I sent you my initial email I had a discussion with Inspector Inkley and Inspector Sears,concerning the window
protection issue. I interpreted the inspection comments as relating to the fall protection provisions. However, I am
advised the outstanding item relates to the "Protection of Openings" as cited in Building Code Section R301.2.1.2, as
amended,for Windborne Debris Zones.
Accordingly, I am attaching copies of those Code provisions with the associated commentary. Your variance application
should reference this Code Section. Disregard the previously cited Sections. As stated, it is imperative this be addressed
immediately.

Mr.Jackson:
This to serve as a follow up to my email of February 7, 2018 and my letter of February 1, 2018, concerning 4 Jessies Lane
South Yarmouth, Certificate of Occupancy. As per your request I provided you with the Building Code Board of Appeals
application and instructions on February 7. However,as of today, I have not heard from you as to how you intend to
j proceed; with either filing for the Variance or complying with the Wind Zone Opening Protection provisions. In either
case, as previously stated you must proceed immediately with one of these measures. Failure to do so will result in
enforcement action which will include the issuance of tickets which range from $100 for the first offence to$1,500 for
the third and subsequent offences. Each day without a Certificate of Occupancy constitutes a separate violation.

Dear Mr. Jackson:
This is to serve as a follow up to my February 1, 2018 letter, (copy enclosed)concerning the lack of a
Certificate of Use&Occupancy for the newly constructed single family house at4 Jessies Lane, South
Yarmouth,resulting in the following violation:
VIOLAITON-780CMR, State Building Code, Section 111.1-Use and Occupancy provides that"No
building or structure shall be used or occupied—until the Building Offical has issued a certificate of
occupancy-."
Reasons for Violation:
1. The latest Temporary Certificate of Occupancy expired January 1, 2018 (issued October 6,
2017).
2. Compliance with the high wind zone opening protection provisions have not been complied
with nor have you applied for a variance.
Because it has been almost one year since construction has been completed and three Temporary
Certificates of Occupancy having been issued,it is imperative the opening protection requirements in
a high wind zone be addressed and brought to a conclusion immediately. In the event of an
occurance where an insurance claim would have to be filed,you may have difficulty with your
insurance company without having a lawful Certificate of Occupancy.
Accordingly, you are hereby ordered to take appropriate remedial measures to abate this outstanding
issue within thirty(30)days. Failure to do so will result in appropriate enforcement action,which will
include the issuance of tickets with fines from$100 for the first offense, $500 for the second offense
and$1,500 for the third and subsequent offencses. I consider failure to comply within thirty days as the
first offense and each succeeding thirty day intervals as second and third offenses.
