Dear Members of the Commission:
On behalf of Colonial Gas Company d/b/a National Grid, Tighe & Bond respectfully submits one
original and seven (7) copies of this Request for Determination of Applicability (RDA) for the
proposed gas line extension of an existing gas main from the intersection of Thacher Shore
Road and Flintlock Way for approximately 100 linear feet (lf) east to the residence at 99
Thacher Shore Road in Yarmouthport, Massachusetts. A residential service line will be installed
on this new segment of gas main through the driveway to the residence. Thacher Shore Road
is a narrow, paved roadway serving a number of single-family residences. Short Wharf Creek
is located to the east and north of the project area. Barnstable Harbor is located north of the
project area. The Mill River is located northwest of the project location.
This RDA is being filed since a portion of the proposed work will occur within the 100-foot
Buffer Zone to Bordering Vegetated Wetlands (BVW), Salt Marsh, and Coastal Bank, the 200-
foot Riverfront Area, as well as within Land Subject to Coastal Storm Flowage (LSCSF). In
addition, work will occur within the locally-regulated 35-foot No Disturbance and 50-foot No
Build Setbacks to these areas, as well as the 300-foot Buffer Zone to Major Estuaries. These
areas are regulated under the Massachusetts Wetlands Protection Act (WPA, M.G.L. c. 131
§40) and the Town of Yarmouth Wetlands Protection Bylaw (Chapter 143) and its
implementing regulations.
Please note, a portion of the proposed work is considered an exempt buffer zone minor activity
under 310 CMR 10.02(2)(b)(2)(i), as it consists of “Installation of underground utilities (e.g.,
electric, gas, water) within existing paved or unpaved roadways and private
roadways/driveways, provided that all work is conducted within the roadway or driveway and
that all trenches are closed at the completion of each workday.”
All of the proposed work will occur in upland areas with no anticipated impacts to the
surrounding wetland resources. Tighe & Bond respectfully requests that the Yarmouth
Conservation Commission make the following Negative Determination-B(2): “The work
described in the Request is within an area subject to protection under the Act, but will not
remove, fill, dredge, or alter that area. Therefore, said work does not require the filing of a
Notice of Intent.”

The following text discusses the wetland resource areas, proposed activities, and proposed
protective measures.
Wetland Resource Areas
Site reconnaissance and wetland resource investigations of the project area were conducted on
June 28, 2018. The reconnaissance was conducted in accordance with the Massachusetts
Department of Environmental Protection (MassDEP) guidelines, 310 CMR 10.00, and Chapter
143. The resource area boundaries were surveyed using an iPad paired with an R1 (real-time
submeter Bluetooth GPS receiver) unit.
• Coastal Bank: The bank varies in composition. In areas closest to the project, it is
comprised of the side slopes/shoulders of the roadway. This regulatory bank is a
seaward-facing elevated landform, as it abuts an area subject to the ebb and flow of the
tide. The Coastal Bank confines the Short Wharf Creek and the surrounding salt marsh
system.
• Salt Marsh: A salt marsh is situated north of 99 Thacher Shore Road along Short Warf
Creek and is best characterized as an estuarine intertidal emergent marsh (EIEM). The
boundaries of the wetland coincided with the edge of fill associated with the roadway and
toe of the slope. Common vegetation identified included smooth cordgrass (Spartina
alterniflora), common reed (Phragmites australis), saltmeadow cordgrass (Spartina
patens). Salt marsh elder (Iva frutescens) and sweet pepperbush (Clethra alnifolia) were
identified along the fringes of the wetland.
• Bordering Vegetated Wetland: A Bordering Vegetated Wetland (BVW) occurs north of
the residence at 99 Thacher Shore Road and to the east of the residential driveway on
the fringes of the salt marsh. This wetland is best classified as a Palustrine Forested
(PFO) wetland. The boundary of the wetland coincides with the edge of fill associated with
Thacher Shore Road and the residential driveway. Commonly observed vegetation
included skunk cabbage (Symplocarpus foetidus), red maple (Acer rubrum), highbush
blueberry (Vaccinium corymbusum), cinnamon fern (Osmunda cinnamomea), and
sensitive fern (Onoclea sensibilis).
Another BVW occurs on the west side of the residential driveway. This wetland is best
classified as a PFO wetland. The boundaries of the wetland also coincided with the edge of
fill associated with the roadway and toe of the slope. Vegetation identified was similar to
the vegetation in the wetland previously discussed.
• Riverfront Area: Short Warf Creek is shown as a perennial stream on the USGS
topographic map (Hyannis, Massachusetts; 1979). Accordingly, a 200-foot Riverfront
Area extends horizontally from the banks of Short Warf Creek. Riverfront Area at this site
consists of adjacent wetlands and areas of upland that include a paved roadway, gravel
driveway, and maintained residential lawn.
• Land Subject to Coastal Storm Flowage: The Federal Emergency Management
Agency (FEMA) flood map (Panel No. 25001C0559J, effective July 16, 2014) was
consulted to evaluate the presence of Land Subject to Coastal Storm Flowage. A portion
of the project site falls within Zone AE, an area subject to flooding and/or inundation by
the 100-year flood with a base elevation of 12 feet (NAVD88). Accordingly, the northern
portion of the project site is regulated as Land Subject to Coastal Storm Flowage.

Rare Species
The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (14th
edition; August 1, 2017) and MassGIS online (August 2017) were consulted during the
preparation of this RDA. According to these sources, the project area does not fall within
Priority Habitats of Rare Species or Estimated Habitats of Rare Wildlife (Figure 2).
Proposed Activities
The proposed work involves the extension of the existing underground gas main within
Thacher Shore Road east for approximately 100 lf to provide a residential gas service
connection to 99 Thacher Shore Road. The gas main extension will consist of a two-inch
plastic pipe. The service connection will be approximately 660 lf and will consist of a one-inch
plastic pipe within the existing driveway. Construction is anticipated to occur during the Fall
2018 season.
Construction of the new main will require the excavation of a two-foot wide trench to safely
install the underground gas main. The trench bottom will be excavated and graded so that the
pipe will be supported for its entire length on undisturbed bottom. The new gas main will be
buried to a depth of approximately three feet below surface grade. Upon the completion of
work, the trench will be backfilled and the site will be restored to pre-existing conditions. Work
can be conducted by conventional construction equipment parked on the existing roadway,
residential driveway, and lawn.
The work will occur within the 100-foot Buffer Zone and the locally-regulated 35-foot No
Disturbance and 50-foot No Build Setbacks to BVW, as well as within LSCSF. The existing
buffer where the work is proposed consists of a residential driveway and Thacher Shore Road.
None of the proposed installation will occur within the naturally-vegetated buffer. The
proposed work will not change the general characteristics of the area, as the entire project is
contained within previously disturbed areas, residential driveway, and the roadway right-of-
way (ROW). Approximately 1,238 square feet (sf) of work will occur within the 100-foot Buffer
Zone across the project area. Approximately 1,060 sf and 1,119 sf of work will occur within
the 35-foot No Disturbance and 50-foot No Build Setbacks, respectively. Approximately 831 sf
of work will occur within the 300-foot Buffer Zone to Major Estuaries. Approximately 875 sf of
work will occur within LSCSF.
Protective Measures
The proposed extension will occur within the existing roadway and on the residential property.
During the installation activities, appropriate erosion control measures will be installed at the
downgradient limit-of-work to protect the nearby resource areas from any adverse impacts.
Attachment D of this submittal includes details of standard erosion control measures that have
been used in past projects of similar scope. Following the completion of construction activities,
paved areas will be restored and any disturbed soils will be mulched with straw.
Fees
As required under Chapter 143, two checks made payable to the Town of Yarmouth for the
application filing ($75) and the advertisement fee ($10) have been enclosed. Copies of the
checks have been provided in Attachment A.

Summary
We look forward to having the opportunity to discuss this project with the Yarmouth
Conservation Commission at the public hearing on August 2, 2018. We anticipate these
materials are sufficient for the Commission to issue a Negative Determination confirming that
“The work described in the Request is within an area subject to protection under the Act, but

General Information:
All filings must be made on Town of Yarmouth forms. All applications must be submitted two weeks
prior to the next scheduled Conservation Commission meeting. No new information may be accepted
into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative
Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised
for a Public Hearing. Refer to the meeting and fee schedule. Contact the office if you need assistance.
We will be happy to help guide you through the process.
Submitting an Application:
