Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of property as required by law, and to the public by posting notice of the hearing and publishing in The Register,the hearing opened and held on the date stated above. The Petitioner is Aphrodite C.Norton who seeks relief in connection with property located at 117 North Main St.,South Yarmouth,MA.The Petitioner appeared as did Ryan P.Holmes,co-owner who spoke eloquently as to the circumstances which gives rise to the requested relief.Petitioner seeks relief by way of a Special Permit to restore use of a Family Related Apartment at 117 North Main St.,South Yarmouth Mass.,property located in a Zoning District R-40. The Petitioner's property contains a one family structure and a separate two-car garage with apartment above.It had previously been utilized as a Family Related Apartment having received the benefit of a Special Permit in Petition#4308.Due to nonuse as a Family Related Apartment and the transfer of the property from the predecessors to obtain the Special Permit to the current Petitioner and Mr.Holmes that prior Special Permit had lapsed.The Petitioner advised the Board that her daughter,age 23,intended to occupy the Family Related Apartment if that right could be restored by Special Permit Incorporated hereto by reference are thea�Mtnt Affidavit and the Declaration • Of Covenants for a Family Related Accessory Apartment The Board found that there would be no undue nuisance, hazard nor congestion by the grant of a • Special Permit nor would it result in no undue hazard, nuisance or congestion nor cause any substantial hardship to the existing or future character of the neighborhood or Town. . 1
