2.15 RESPONSIBILITY OF EACH LICENSE HOLDER:
2.15.1 THE LICENSE HOLDER SHALL BE FULLY AND COMPLETELY RESPONSIBLE FOR ALL WORK FOR WHICH HE
IS SUPERVISING. HE SHALL BE RESPONSIBLE FOR SEEING THAT ALL WORK IS DONE PURSUANT TO THE STATE
BUILDING CODE AND THE DRAWINGS AS APPROVED BY THE BUILDING OFFICIAL
2.15.2 THE LICENSE HOLDER SHALL BE RESPONSIBLE TO SUPERVISE THE CONSTRUCTION, RECONSTRUCTION,
ALTERATION, REPAIR, REMOVAL OR DEMOLITION INVOLVING THE STRUCTURAL ELEMENTS OF BUILDING
AND STRUCTURES ONLY PURSUANT TO THE STATE BUILDING CODE AND ALL OTHER APPLICABLE LAWS OF THE
COMMONWEALTH, EVEN THOUGH HE, THE LICENSE HOLDER, IS NOT THE PERMIT HOLDER BUT ONLY A SUB-
CONTRACTOR OR CONTRACTOR TO THE PERMIT HOLDER.
2.15.3 THE LICENSE HOLDER SHALL IMMEDIATELY NOTIFY THE BUILDING OFFICIAL IN WRITING OF THE
DISCOVERY OF ANY VIOLATIONS WHICH ARE COVERED BY THE BUILDING PERMIT.
2.15.4 ANY LICENSEE WHO SHALL WILLFULLY VIOLATE SUBSECTIONS 2.15.1, 2.15.2 OR 2.15.3 OR ANY
OTHER SECTION OF THESE RULES AND REGULATIONS AND ANY PROCEDURES, AS AMENDED, SHALL BE SUBJECT
TO REVOCATION OR SUSPENSION OF LICENSE BY THE BOARD.
2.16. ALL BUILDING PERMIT APPLICATIONS SHALL CONTAIN THE NAME, SIGNATURE AND LICENSE NUMBER OF
THE CONSTRUCTION SUPERVISOR WHO IS TO SUPERVISE THOSE PERSONS ENGAGED IN CONSTRUCTION, RECON-
STRUCTION, ALTERATION, REPAIR, REMOVAL OF DEMOLITION AS REGULATED BY SECTION 109.1.1 OF THE
CODE AND THESE RULES AND REGULATIONS. IN THE EVENT THAT SUCH LICENSEE IS NO LONGER SUPERVISING
SAID PERSONS, THE WORK SHALL IMMEDIATELY CEASE UNTIL A SUCCESSOR LICENSE HOLDER IS SUBSTITUTED
ON THE RECORDS OF THE BUILDING DEPARTMENT.

Therefore. the COMMISSION hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth in the regulations, to protect those inter-
ests checked above.The COMMISSION orders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol. •
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent, the conditions shall control.
General Conditions • •
'• 1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
•
2. 'This Order does not grant any property rights or any exclusive privileges:it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes. ordinances.by-laws or regulations.
». .The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act:or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years.from the date of issuance and both that date and the special circumstances warranting
•
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authonty for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill,containing no trash,refuse, rubbish or de-
bris, including but not limited to lumber, bricks, plaster,wire,lath, paper, cardboard, pipe, tires, ashes.
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed, until all proceedings before the Department have been completed.

8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
•
Court for the distnct in which the land is located, within the chain of title of the affected property. In the
case of recoroec land, the Final Order shall also ce noted in the Registry's Grantor Index under the name

15. These orders of conditions shall apply to any successor in interest or
successor in control.
16. The area between the house and the rip-rap shall be planted with
beach grass.
17. The driveway shall be constructed of stone or gravel.
18. A hay bale dike shall be staked in place as shown on the
plan, before any work begins on the project.
19. This dike shall constitute a work limit line. No work of
any kind will be permitted on the wetland side of this line.
20. The hay bale dike shall remain in place upon completion of
the project and allowed to decay naturally.
21. Gutters and downspouts directed into drywells shall be •
installed to provide for roof runoff.
22. Any fill required, (see General Order #6, ) shall be clean
sand and contain no material over 12 inches in diameter.
23. Any area proposed for removal of vegetation for a period
of [ore than 7 days, shall be mulched or otherwise treated
to prevent erosion
24. The deck is not to be closed in for future habitation without
' a filing of a Notice of Intent.
25.The applicant shall be responsible for having a copy of the
Orders of Conditions on the site at all times. Failure to
do so could possibly result in a revocation of the Order,
or a fine, or both.
26.Upon completion of the project a Certificate of Compliance
shall be requested. This Order shall be considered
incomplete until the Certificate of Compliance is recorded.

Please be advised that the Town of Yarmouth Public water supply is
available to service lot/parcel(s) N68 street 43 Cove Rd.
as shown on Assessors sheet/map 10 .
Issuance of this Letter of Availability is subject to the following
provisions/restrictions:
(1) The property owner agrees to comply with all Federal, State and
Local Laws, Rules and Regulations as they pertain to the use of the Public
water supply.
(2) The Town of Yarmouth Water Department shall have exclusive rights
as to the size, number, type and location of all water service lines, fire
service lines or appurtenant items connected to the water distributon
system.
(3) The Yarmouth Water Department reserves the right to require, at
the property owners expense, the installation of water mains and appurtenant
items to meet water demand requisites within any structure relevent to this
Letter of Water Availability.
(4) This Letter of Water Availability will expire 180 days from date of
issue.
