provisions/restrictions:
(1) The property owner agrees to comply with all Federal, State and
Local Laws, Rules and Regulations as they pertain to the use of the Public
water supply.
(2) The Town of Yarmouth Water Department shall have exclusive rights
as to the size, number, type and location of all water service lines, fire
service lines or appurtenant items connected to the water distributon
system.
(3) The Yarmouth Water Department reserves the right to require, at
the property owners expense, the installation of water mains and appurtenant
items to meet water demand requisites within any structure relevent to this
Letter of Water Availability.
(4) This Letter of Water Availability will expire 180 days from date of
issue.

Findings
The Town of Yarmouth Conservation Commission has reviewed the above-referenced Notice of
Intent and plans and has held a public hearing on the project.Based on the information available to the
COMMISSION at this time,the COMMISSION has determined that
the area on which the proposed work is to be riche is significant to the following interests in accordance with
the Presumptions of Significance set forth in the regulations for each Area Subject to Protection Under the
Act(check as appropriate): '

'efore,the COMMISSION hereby finds that the following conditions are '
ecessty,in accordance with the Performance Standards set forth in the regulations,to protect those inter-
ests checked above.The COMMISSION orders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above.To the extent that the fol-
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent,the•conditions shall control. .
General Conditions • .
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas-
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
• to private property or invasion of private rights. -
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes,ordinances,by-laws or regulations. •
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply: • .
• (a) the work is a maintenance dredging project as provided for in the Act; or .
' (b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the date of issuance and both that date and the special circumstances warranting .
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
• upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill,containing no trash,refuse,rubbish or de-
bris,including but not limited to lumber,bricks,plaster,wire,lath,paper, cardboard,pipe,tires,ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,if
such an appeal has been filed,until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district In which the land is located,within the chain of title of the affected property.In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name •
of the owner of the land upon which the proposed work is to be done.In the case of registered land,the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the COMMISSION
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words,"Massachusetts Department of Environmental Quality Engineering;
File Number SE 83-888 ".
• 10.Where the Department of Environmental Quality Engineering is requested to make a determination and
' to issue a Superseding Order, the Conservation Commission shall be a party to alll agency proceedings
and hearings before the Department. x
11.Upon completion of the work described herein,the applicant shall forthwith request in writing that a
Certificate of Compliance be issued stating that the work has been satisfactorily completed.

16. The driveway shall be constructed of stone or gravel.
17. Excess material, if any, excavated from the area of the
...building foundation and septic system, not required for
backfill and grading, shall be disposed of only at loca-
tions approved by the Conservation Officer.
18. A hay bale dike shall be staked in place as shown on the
plan, before any work begins on the project.
19. This dike shall constitute a work limit line. No work
of any kind will be permitted on the wetland side of -this
line.

20. The hay bale dike shall remain in place upon completion
of the project and allowed to decay naturally.
21. Gutters and downspouts directed into drywells shall be
installed to provide for roof runoff.
22. Any fill required, (seeGeneral Order #6 ) shall be clean
sand and contain no material over 12 inches in diameter. ,
23. Any area proposed for the removal of vegetation for a
period of more than 7 days shall be mulched or otherwise ,
treated to prevent erosion.

24. The deck is not :to be closed in for future habitation with-
out a filing of a Notice of Intent. .
25. Upon completion of the project a Certificate of Compliance
shall be requested. This Order shall be considered incom-
plete until the Certificate of Compliance is recorded.

ADDITIONAL INFORMATION FOR MAKING AND FILING AN APPLICATION
FOR A CERTIFICATE OF APPROPRIATENESS
The four categories for which a Certificate of Appropriateness Is required are: (application for demolition or removal is a
separate form).
1. EXTERIOR BUILDING CONSTRUCTION (new or existing buildings): An application is required for any exterior of a
building to be erected or altered including windows,doors,siding,roof,light etc.,that will be visible from any public street,
way or public place.The following scale drawings are required in duplicate with application:two plot plans(if addition-show
existing buildings in outline),four sets of elevations.Also required are snap shots of existing buildings,where additions or
alterations are to be made. No plot plan is required for addition or alteration which does not touch the ground.
2.EXTERIOR PAINTING:An application is required for any portion of a building,structure or sign to be painted that's visible
from a public street,way or public place.Color samples must be attached to these applications.An application is not required
when repainting existing colors,changing to white, or using colors approved by the Town Historic District Committee.

3.SIGNS OR BILLBOARDS:An application is required for any sign or billboard to be erected within the District,with the
following exceptions:
a: Existing signs or billboards on November 27, 1974 shall have until November 27:1977 to secure an approved •
Certificate of Appropriateness.:!
b..temporan signs for use in connection with any official celebration or parade or any charitable drive as long as they
are removed within three days of the event.Certain temporary signs that the Committee feels does not detract from
the Act may be allowed with the prior permission of the Committee.
c. Real Estate signs of not more than 3 square feet in area advertising the sale or rental of the premises on which they
are erected or displayed.

7.A separate application must be filed with each project requiring a Certificate of Appropriateness.

The Old King' s Highway Committee, meeting 10/3/90, reviewed
Mr. Moulton' s request for one change to previously approved plans--
the submission of a revised site plan for a new house at
41 Freeboard Lane, Yarmouth Port.
The committee voted unanimously to deny Mr. Moulton' s request and
to ask the Building Inspector to notify him to refile the site plan
on a Certificate of Appropriateness.
The consensus of the committee was:
1. That this particular revised site plan is viewed by the
committee as a major change rather than as a minor change.
2. That the revised location of the house has both a major impact
on the setting and on a direct abuttor' s house at 49 Freeboard
Lane and therefore is not considered appropriate.

3. That the revised site plan includes a retaining wall which was
not on the original application approved 4/4/90 and therefore
requires filing a Certificate of Appropriateness.
