The Yarmouth Board of Health, having received your application fora Variance
frau the provisions of Regulation of Title 5 of the
State Environmental Code and/or fran the Town of Yarmouth Amendments, Section
3.7 , for a Subsurface Sewage Disposal System and, having deter-
mined that strict-enforcement of these regulations in this instance would do
manifest injustice and, further, that your requested variance does not conflict
with the spirit of the State Environmental code nor the Town of Yarmouth Amend-
ments, has hereby granted the variance which shall became effective on the a-
bove indicated date, thus fulfilling the 30-day filing notification require-
:rents of the Deparirr_nt of Environmental Quality Engineering. The variance(s) ,
as granted at-the Board Of Health Mooting on July 2, 1990 , are
as follows:
Town Sec. 3.7
1) To allow reserve septic leaching to be less than the required 100' to
a watercourse wetlands). A proposed distance of 90' from wetlands to
reserve leaching. A variance of 10' .
2) To allow primary septic leaching to be less than the_required_ 100 rto a
watercourse (wetlands). A proposed distance of 92' from wetlands to
primary leaching. A variance of 8' .
The design engineer is to inspect and certify the septic installation.
Per plan by A.M. Wilson & Associates, dated 5/25/90.
You are further advised that no work shall be carmenced under this variance un-
til the elapse of the thirty day filing period and that the variance granted
herein shall expire in ninety (90) days frau the effective date. Furthermore,
that all work so authorized by said variance shall be completed prior to, or on,
the date of expiration.
In granting this variance the Town of Yarmouth shall not be held responsible
for any water dama7 to the foundation, septic system nor adjoining lots.

ADDITIONAL INFORMATION FOR MAKING AND FILING AN APPLICATION
FOR A CERTIFICATE OF APPROPRIATENESS
The four categories for which a Certificate of Appropriateness Is required tire: (application for demolition or removal is a
separate form).
1. EXTERIOR BUILDING CONSTRUCTION (new or existing buildings): An application Is required fur any exterior of a
building to be erected or altered Including windows,doorsisiding,roof,light etc.,that will be visible from any public street, '
way or public place.The following scale drawings are required In duplicate with application: plot plan (If addition-show
existing buildings In outline),floor plan and elevations.Also required are snap shots of existing buildings,where additions or
alterations are to be made. No plot plan is required for addition or alteration which does not touch the ground.
2.EXTERIOR PAINTING:An application Is required for any portion of a building,structure or sign to be painted that Is visible
from a public street,way or public place.Color samples must be attached to these applications.An application Is not requited
when repainting existing colors,changing to white,or using colors approved by the Town Historic District Committee.
3.SIGNS OR BILLBOARDS:An application is required for any sign or billboard to be erected within the District,with the
following exceptions:
a. Existing signs or billboards on November 27, 1974 shall have until November 27, 1977 to secure an approved
Certificate of Appropriateness.
b. Temporarysignsforuseinconnectionwithanyofficialcelebrationorparadeoranycharitabledriveaslongasthey
are removed within three days of the event.Certain temporary signs that the Committee feels does not detract from
the Act may be allowed with the prior permission of the Committee.
c. Real Estate signs of not more than 3 square feet In area advertising the sale or rental of the premises on which they
are erected or displayed.
d. A single sign of not more than 1 square foot In area showing the name,occupation or address of the occupant of the
premises on which they are erected or displayed In a residential zone.
4.STRUCTURE:An application is required to build or alter any structure within the District which is defined by the Act as a
combination of materials other than a building,sign or billboard,but including stone walls,flagpoles,hedges,gates,fences,
etc.
GENERAL REQUIREMENTS
5.Work on projects requiring approval shall not be started until the Certificate of Appropriateness has been filed with the
Town Clerk by the Committee.Approval Is subject to the tO day appeal period provided In the Act.
IL No changes shall be made from the original approved specifications without advance approval of the Commission on an
amended application filed with the Committee.
7.A separate application must be filed with each projectrequiring a Certificate of Appropriateness.
8. Under heading of "Detailed Description of Proposed Work" give detailed data on such architectural features as:
foundation,chimney,siding,roofing,roof pitch,sash and doors,window and door frames,trim,gutters-leaders,roofing and
paint color. •

9.Unless application is complete and legible and all material required is supplied,application will not be accepted or acted

Therefore, the COMMISSION hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth in the regulations, to protect those infer•
ests checked above.The COMMISSION orders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above.To the extent that the fol. •
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent.the conditions shall control.
General Conditions •
1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas-
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges:it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes,ordinances,by-laws or regulations.
4, The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill,containing no trash,refuse,rubbish or de-
bris, Including but not limited to lumber,bricks, plaster,wire,lath,paper,cardboard, pipe, tires,ashes,
refrigerators,motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,if
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located,within the chain of title of the affected property.In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done.In the case of registered land, the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the COMMISSION
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words,"Massachusetts Department of Environmental Protection,
File Number CP a3 - 71° •
10. Where the Department of Environmental Protection is requested to make a determination and to issue
a Superseding Order,the Conservation Commission shall be a party to all agency proceedings and
hearings before the Department.
11.Upon completion of the work described herein,the applicant shall forthwith request in writing that a
Certificate of Compliance oe issued stating that the work has been satisfactorily completed.

13. The applicant shall be held responsible to advise the contractor of all
these orders of conditions.
14. The Conservation Officer shall be notified at least 48 hours prior to
the commencement of the proposed work. Tel.# 398-2231 Ext. 284.
15. These orders of conditions shall apply to any successor in interest or
successor in control.
16. Excess material, if any, excavated from the area of the building
foundation and septic system, not required for backfill and grading,
shall be disposed of only at locations approved by the Conservation
Administrator..
17. A hay bale dike shall be staked in place as shown on the plan, before
any work begins on the project.
18. This dike shall constitute a work limit line. No work of any kind will
be permitted on the wetland side of this line.
19. The hay bale dike shall remain in place upon completion of the project,
and allowed to decay naturally.
20. Gutters and downspouts directed into drywells shall be installed to
provide for roof runoff.
21. Any fill required, (see General Order #6. ) shall be clean sand and
contain no material over twelve (12) inches in diameter.
22. Any area proposed for the removal of vegetation for a period of more
than seven (7) days, shall be mulched or otherwise treated to prevent
erosion.

23. The deck is not to be closed in for future habitation without a filing
of a Notice of Intent.
24. The applicant shall be responsible for having a copy of the Orders of
Conditions on the job site at all times. Failure to do so could
possibly result in a revocation of the Order of Conditions, or a fine,
or both.
25. Upon completion of the project a Certificate of Compliance shall be
requested. This Order shall be considered incomplete until the
Certificate of Compliance is recorded.

The Yarmouth Board of Health, having received your application for a Variance.
flow the provisions of Regulation - - - of Title 5 of the
State Environmental Code and/or from the Town of Yarmouth Amendments, Section
3. 7 , for a Subsurface Sewage Disposal System and, having, deter-
mined that strict enforcement of these regulations in this instance would do
manifest injustice and, further, that your requested variance does not conflict
with the spirit of the State Environmental Code nor the Town of Yarmouth Amend-
ments, has hereby granted the variance which shall become effective on the a-
bove indicated date, thus fulfilling the 30-day filing notification require-
ments of the Department of Environmental Quality Engineering. The variance(s) ,
as granted at-the Board of Health Meeting on December 17 , 1990 , are
as follows:
Town Sec. 3 . 7
1 ) To allow reserve septic leaching to be less than the required
100 ' to a watercourse (wetlands ) . A proposed distance of 90 ' from
wetlands to reserve leaching. A variance of 10 ' .
2) To allow primary septic leaching to be less than the required 100 '
to a watercourse (wetlands) . A proposed distance of 92 ' from
wetlands to primary leaching . A variance of 8 ' .
The design engineer is to inspect and certify the septic installation.
Per plan by A.M. Wilson & Associates, dated 05/25/90.
You are further advised that no work shall be commenced under this variance un-
til the elapse of the thirty day filing period and that the variance granted
herein shall expire in ninety (90) days from the effective date. Furthermore,
that all work so authorized by said variance shall be completed prior to, or on,
the date of expiration.
In granting this variance the Town of Yarmouth shall not be held responsible
for any water damage to the foundation, septic system nor adjoining lots.
