DECISION
The Petitioner requested a special permit under Section
104 .3. 2 to allow a second floor to be constructed within the
existing building on Parcels E13 and E12, on Yarmouth Assessor 's
Map 88 being 307 White 's Path, South Yarmouth, Mass . , the second
floor area to be used by the non-profit community access
television corporation for providing local access to television
via existing cable facilities or by another public purpose
corporation for the same or related purpose . In addition, the
petitioner , in the alternative or in conjunction therewith
applied for a variance to allow a non-profit community access
television and other public purpose corporation to occupy the
above referenced building as modified with a second floor with
only thirty-one parking spaces.

It appearing that notice of said hearing has been given by
sending notice thereof to the petitioner and all those owners of

required by statute , and that public notice of such hearing has
been given by publication in the Yarmouth Sun. The hearing was
opened and held on July 26 , 1990 .

REASONS FOR DECISION
The Board determined that the requested relief, if it were to
be granted, should be by way of a variance rather than by special
permit.
The petitioner presented the following information and the
Board finds the following as facts in support of its decision.
Cape Cod Community Television Corp. is a non-profit community
access television corporation formed almost two years ago. The
corporation was formed in accordance with an agreement between
Cape Cod Cablevision and the Towns of Yarmouth, Barnstable,
Dennis, Harwich and Chatham. The main purpose of Cape Cod
Community Television Corp. is to serve the public of the five
towns with a means of local access television programming.
To accomplish its goal the petitioner needs a television
studio, editing facility and general offices in a location
accessible to the public and Cape Cod Cablevision's transmission
line . Cape Cod Community Television Corp. applied for and
received a special permit and variance from the Town of Yarmouth
Zoning Board of Appeals in Case No. 2672 to have their office and
studio on White' s Path in South Yarmouth.
It was submitted and the Board finds that in remodeling the
building the petitioner will have to create a structure to hold a
ceiling for the first floor of the building . The building is of
sufficient height that it is necessary to have a ceiling
installed within it for the first floor . The building, which is
in existence, will not be enlarged as it is high enough to
contain a second floor . The Board found that it is possible to
have the floor structure capable of supporting a usable second
floor at a cost that is not unreasonable compared to the total
initial cost of remodeling .
The Board found that the present building conforms to the
Zoning By-law and that the requested relief should be granted by
way of a variance to the existing provisions of the Yarmouth
Zoning By-law and not by way of a special permit to alter or
• change a pre-existing nonconforming structure .
On motion duly made and seconded it was unanimously voted to
issue a variance to Cape Cod Community Television Corp. to allow
a second floor to be constructed within the existing building
with only thirty-one parking spaces available-and. that,;thMOi
existing parking spaces can remain as they exist as said&'parking
area is shown on a plan by Low & .Weller dated May 5, 1988 ,
submitted and on file in Yarmouth Zoning Bo9j0 -2of pfpeals7Case
No. 2672, said premises to be used by the petittbnar to provide
for local community access television and by other public purpose

corporations for the same or related purposes.
The Board finds that the building and parking area as they
exist, being located on White' s Path, in a location accessible to
the public and Cape Cod Cablevision' s transmission line is a
unique set of circumstances. Based on those unique circum-
stances , Cape Cod Community Television Corp. applied for and
received special permits and variances from the Yarmouth Zoning
Board of Appeals in Case No. 2672. The petitioner has the right
to use and occupy the premises at 307 White ' s Path, South
Yarmouth, and to deny the petitioner the right to fully utilize
the building would be a hardship to the petitioner . The Board
finds that if a second floor is ever to be used within the
structure , that it would be a financial hardship on the
petitioner to build the structure to hold the ceiling for a first
floor and the ceiling itself , and not have that structure strong
enough to support a second floor and intended use of a second
floor . The cost of dismantling the structure built sufficient
only to hold up the ceiling of the first floor, and to replace it
with a structure that would be strong enough to hold the ceiling
of the first floor , as well as be the base of a second floor ,
would far exceed the cost of building that structure strong
enough initially and that excess cost would be a financial
hardship to the petitioner .
The Board finds that the variance may be granted without
substantial detriment to the public good in that the petitioner's
use of the building even with a second floor and with only
thirty-one parking spaces will not have a substantially different
affect on the community than the building will otherwise have.
The Board finds that it is unlikely that the petitioner 's use of
the premises, even with the second floor and even if use is made
by other public purpose corporations in addition to the
petitioner ' s use for the same or related purposes , will require
the use of more than the thirty-one parking spaces . The Board
finds that it is unlikely that the building will contain more
than fifty persons at any one time and that the building will
normally be used by substantially fewer than fifty people on a
regular basis . The Board finds that the intensity of use will
not be greater than originally expected even with the con-
struction of a second floor and , therefore , a variance from the
Town of Yarmouth Zoning Ey-laws parking requirements with the
building containing a second floor within the existing structure
is justified .

The Board finds that the granting of the variariie 'will not"
nullify nor substantially derogate from the intent or purpose of
the zoning by-law in that the number of required parking spaces ;
is based upon the likely parking demand. In the pa p,clifac
zoning district for the petitioner ' s site , with the possible uses

of the land and structure, normally it would be appropriate to
have one parking space for each potential occupant of the
building . Upon the petitioner' s representations regarding the
proposed use of the building and upon the Board ' s finding that
those conditions are likely to exist and based upon the
hereinafter proposed conditions the Board finds that the overall
intent and purpose of the By-law will not be nullified by the
grant of the variance .
Members of the Board voting in favor: Leslie Campbell, Fritz
Lindquist, Judith Sullivan, Philip Magnuson and Ronald Schmidt.
Members of the Board voting in opposition: None
Therefore by a vote of five in favor and none opposed , the
petitioner ' s request for a variance to the parking requirements
under Sections 301.3 through 301. 4.9 and 301. 5 is granted subject
to the conditions that the parking is constructed and/or
maintained as shown on the parking plan by Low & Weller dated May
5, 1988 submitted and on file in Case No. 2672; that all site
work previously imposed in Yarmouth Zoning Board of Appeals Case
No. 2672 be completed; and that the variance is only for such
period of time that the building is principally used as a non-
profit community access television studio and editing facility
with associated general offices.
No permit shall issue until 20 days from the date of filing
the decision with the Town Clerk. ,.

the second floor of said building shall not be open to and/or used by the public until such

Rules and Regulations of the Architectural Access Board, 521 CMR, as amended from time to
