PROPERTY LOCATED AT: 13 Hastings Avenue, West
Yarmouth, MA and shown on Assessor' s Map 57 as Parcel J67.
PETITIONER REQUESTS: A Variance from the terms
of the Yarmouth Zoning By-Law to allow an enclosed porch with
the minimum rear footage setback requirement of 20 feet ( R-
40 Zone) Variance of 10 . 2 feet . § 203. 5

It appearing that notice of said hearing has been given by
sending notice thereof to the petitioner and all those owners
of property deemed by the Board to be affected thereby and .
that public notice of such hearing having been given by
publication in the Yarmouth Sun, the hearing was opened and
held on the date first above written.
REASON FOR DECISION:
The petitioner appeared at the hearing with his attorney,
John J. Moore , Esq. and filed a memorandum to supplement his
oral presentation. Based upon the evidence presented, it
appears that the petitioner is the first owner and occupant
of this house , which was constructed in 1981 . The house -r -
contains
r "contains 10, 889 square feet of land area, upon which is
situated the applicant ' s single family home. At the rear
( southwest ) corner of the house , is situated a poured concrete
patio , measuring 14 x 16 feet . At its closest point , the
patio is 9. 8 ' from the rear lot line. The house , at its
closest point , is approximately 24 ' from the rear lot line .
The petitioner proposes to construct an enclosed porch on
the site of the patio , of the same size as the patio , but
shifted approximately 5 ' to the south. This shifting is due
to the existing roof-line of the house.
The property in question is located in an R-40 zone, in a
thoroughly developed residential neighborhood , where the other
lots are comparable in size to the petitioner' s lot . However,

the house is situated near the apex of two converging streets .
Accordingly, his rear lot line is not parallel to the front ,
making the rear lot line significantly closer to the house
at one• corner than at the other, and leaves the petitioner
with insufficient rear yard distance to accomodate such an
addition. By contrast the northerly corner of the housetis_ approximate
35' from the rear lot line. The portion of the lot in question •
is abutted by two properties , but neither- ',s house is situated
near the proposed addition. Therefore no existing structures
will be encroached upon by the proximity of the addition to
the lot line.
By personal appearance and correspondence, several neighbors ,
including all of the immediate abutters , voiced their support
for the petitioners . No one appeared in opposition. The
petitioner' s counsel indicated that he had reviewed this matter
with .the Health Officer and that no upgrade of the septic
system would be required for . this project .
The Board is satisfied that there are special circumstances
relating to the shape of this lot , and that it is these
circumstances which prevent the requested addition. The
majority of the Board are satisfied that these circumstances
as outlined above, impose a hardship to the petitioners and
that the relief requested can ge granted without substantial
derrogation from the intent and purpose of the By-Law, and
without substantial detriment to the public good.
A motion was therefore made by Mr. Halverstadt , seconded by
Mr. Reid, to grant the petition. Mr. Campbell, Mr. Halverstadt
Mr. Magnuson and Mr. Reid voted in favor of the motion, Mr.
Lindqist voted against the motion. The motion therefore
carried 4 : 1 .
The Variance is therefore granted.
No permit shall be issued until 20 days from the date of filing
of th • aecision wi the Town Clerk.
