' C BOARD OF APPEALS 0 DECISION G 47,4 toe '18pPR27PH4:15 REC FILED WITH TOWN CLERK: April 27,2018 PETITION NO: 4733 HEARING DATE: April 26,2018 PETITIONER: Thomas E.Paquette and Barbara E.Paquette PROPERTY: 77 Neptune Lane,South Yarmouth,MA Map& lot#:0024.161; Zoning District: R-25 Book/Page: 27453/270 MEMBERS PRESENT AND VOTING: Chairman Steven DeYoung,Dick Martin,Tom Baron, and Susan Brits Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of property as required by law, and to the public by posting notice of the hearing and publishing in The Register, the hearing opened and held on the date stated above. The Petitioner seeks a Special Permit pursuant to Zoning Bylaw §104.3.2(2) in order to alter, extend and/or raze and replace a portion of a legally pre-existing non-conforming dwelling. The property is located in the R-25 Zoning District and is improved with a one story single family dwelling having 2 bedrooms and I bath, and constructed in approximately 1978. The lot contains 9,200 square feet and it fronts on the Parkers River. The existing structure complies with the front and rear setbacks, and is 8 feet from the southeasterly boundary, and 11.2 feet from the northwesterly boundary. The house also has an attached one car garage and a breezeway facing the road. This configuration creates a U shaped void on the front of the house. The existing building coverage calculation is 16.5%. The existing septic system was installed in 2010, is located in the front of the property, and will remain. The proposal is to remove the attached single car garage and breezeway, and construct a single car garage with a bedroom above. There will continue to be 2 bedrooms in the dwelling. All of the new structure will be located within the existing footprint. This will result in an additional 160 square feet on the first floor, incorporated into the one car garage, and an additional 466 square feet of living space on the second floor. There will still be only 2 bedrooms at the property, and the height of the new structure will increase from its present 22.8.feet to 24.11 feet and building coverage will increase to 18.2%. The new addition will not be any closer to any boundary than the existing structure. • • The Board was in unanimous agreement that the expansion of the structure would not be substantially more detrimental to the neighborhood, zoning district, or Town, than the existing non-conforming structure, and would not cause undue nuisance, hazard or congestion. Accordingly, a Motion was made by Mr. Martin, seconded by Mr. Baron, to grant the Special Permit, as requested with the following conditions: I. The dwelling shall remain a 2 bedroom home, and any increase in the number of bedrooms would require additional relief from this Board; 2. Petitioner to have the existing septic system reviewed by the Board of Health prior to final approval;and 3. Petitioner shall comply with the Order of Conditions previously issued by the Yarmouth Conservation Commission for this project. The members voted unanimously in favor of the Motion. No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein, the Special Permit shall lapse if a substantial use thereof has not begun within 24 months.
