Yarmouth,Accessory Apartment Dear Mr.Ayoub: x This is to serve as a follow up to my August 9,2018 letter concerning the status of the Family Related Accessory Apartment at 294 Old Main Street, South Yarmouth, MA. That letter requested that you contact me concerning the need to file a new application with the Zoning Board of Appeals. This requirement is set forth in the Town of Yarmouth Zoning Bylaw Section 407.3.1, entitled Permit Procedures and Requirements for family related accessory apartments, wherein it states: Ig , "The Special Permit for a family related accessory apartment shall terminate upon the sale of the property or transfer of title to the dwelling unless the new owner(s) files on the subiecbproperty a new Declaration of Covenants with the Barnstable County Registry of Deeds at the time of transfer or within 45 days of the sale, agreeing to abide by the prior restrictions of the Special Permit" In view that according to the Assessors'records,you took title to the property on April 4,2017 and you have failed to contact me, you are hereby ordered to file the appropriate application with the Zoning Board of Appeals in order to maintain the use of the Accessory Apartment. In the interim, no occupancy is allowed in the unit.
