Scope of Work: 1. Permit and receive approval for the project with the Town of Yarmouth: Historic and Building Departments. 2. Prepare site and interior for construction process: ensure all customer furniture and valuables are stored and clear of work areas (by owner). Add floor protection (where necessary), furniture covering, and zip walls to limit the wear of current floor finishes and mitigate excess dust (as needed). 3. Frame: a. Strip interior trim to expose rough opening. b. Strip exterior trim to expose rough opening. Removal of exterior trim may require the removal or work-around of existing deck railing posts against trim. c. Remove decking in front of slider(as need — planned 2-3 courses). d. Remove existing sliders and inspect sill/jamb area for rot or insect damage. e. Properly flash and spline sill and jamb areas to receive new door. f. Install new Andersen A Series Slider. Slider will be assembled in place (not delivered assembled). g. Install pressure treated decking to replace removed decking in front of slider. 4. Trim/Finishes: a. Install new interior trim to match existing. b. Install new exterior trim; proposed to be composite (Azek or equivalent). Terms and Conditions: PECSG and associated sub-contractors will be responsible for obtaining all required permits through the local Town (Yarmouth) to conduct and complete the project. Owner Rights: Please reference the Massachusetts Home Improvement Contractor Law (MGL chapter 142A)which identifies all un-waivable Owner rights. Owners who secure their own building permits are automatically excluded from all Guaranty Fund provisions of the Home Improvement Contractor Law. Information on the Home Improvement Contractor Arbitration and Guaranty Fund can be referenced in: MA Regulation 201 CMR 14.00. Prescriptive and Non-Prescriptive Work and Updating: PECSG, and associated subcontractors, will construct and install all rough and final finishes in accordance with the current building and energy codes. When conducting remodeling and repair work all areas opened to bare framing will be required to meet current building and energy codes, and pass Town required inspections. Owners are advised that PECSG is providing, to the best of its ability, an accurate estimate for proposed work with the current supplied/visible structural and mechanical conditions. In the event PECSG identifies unsatisfactory building conditions (previously completed), PECSG will identify to the owners corrective construction measures and associated costs in order comply with current building and energy code standards. Owner Advisement's: 1. Budget: Owners are advised to have on hand 5%-8% of the overall budget to account for unforeseen repairs and to update structural and mechanical layouts to meet building and energy code requirements in existing structures. 2. Owners are advised to secure and protect all personal belongings and furniture in the direct and adjacent work areas. PECSG will not be responsible for broken or misplaced items left in or near (adjacent rooms)the area of work. 3. Driveway: PECSG is not responsible for damage or repair to the asphalt driveway during the construction process. PECSG will take best actions to avoid oversized loads, point loads, and excavation activities on or around the driveway. PECSGs' Right to Photograph the Project and Signage: The Owners shall permit PECSG and/or person(s) employed or engaged by PECSG, without compensation or consideration to Owner, to take photographs and videos of the project site for construction documentation and PECSG marketing purposes. Photographs and videos, and any accompanying descriptions, shall not identify the Owner or the property address of the project without the express written consent of Owner.. At any time, the Owner(s) may request duplicate digital copies of photographs for their personal record. Contractor will provide Owners with the names of the subcontractors subject to a written contract. Any person who performs work on your property may also obtain a lien upon your property under Chapter 254 without a written contract. Contractor shall furnish Owners appropriate releases or waiver of lien statement for services rendered for all work performed or materials provided at each time periodic payment is made hereunder. Limited Warranty: Contractor shall correct any work that fails to conform to the requirements of the Agreement and shall remedy any defect due to faulty materials, equipment or workmanship, other than a minor or cosmetic defect, which appears within a period of ONE (1) YEAR from the date of completion. The provisions of this paragraph apply to work done by Subcontractors as well as work done by direct employees of Contractor but specifically exclude work done by Owners or any other contractor. Defects in any appliance or equipment covered by any manufacturer's warranty and defects which are the result of characteristics common to materials, such as, but not limited to, warping or deflection of wood, minor non-structural cracks in concrete, plaster, brick or masonry are excluded from this Limited Warranty. Damage due to ordinary wear and tear, abusive use, misuse or lack of proper maintenance are excluded from this Limited Warranty. Upon receipt of Owner's written report of a defect, if the defective items are covered by this Limited Warranty, Contractor will repair or replace it at no additional charge to Owner within sixty (60) days (longer if weather conditions, labor problems or materials shortages cause delays). The work will be done by Contractor or subcontractors selected by Contractor. The choice between repair and replacement belongs to Contractor in their reasonable judgement plus that of owner. Manufacturers' Warranties: Contractor hereby passes through and assigns directly to Owners any and all manufacturers' warranties on all appliances and equipment supplied under this Contract. Such warranties may include, for example, the following appliances and equipment, although not every project includes all of these items and your project may include appliances or equipment not on this list: refrigerator, range, space heater, washing machine, dishwasher, garbage disposal, ventilating fan and air conditioner. Information provided by the manufacturers' on how to comply with their warranty programs will be left in the individual appliances or equipment. Default. If either Contractor or Owner defaults in the performance of any term, provision or condition hereof and the same is not corrected within 45 days after notice of such default is given to such defaulting party by the other then such defaulting party shall be considered in "Default" under this Agreement. 2. Remedies of Owner Default. If Owner is in Default then at any time thereafter, with written notice to Owner, Contractor may terminate this Agreement and bring a legal action to recover damages it has suffered or incurred as a result of Owner's Default. The term "Damages" shall include the costs of obtaining the services of professional counsel in the assistance to collect any unpaid debts or material costs associated with the work completed. 3. Remedies for Contractor Default. If Contractor is in Default then at any time thereafter, with written notice to Contractor, (i) Owner may terminate this Agreement and bring a legal action to recover its Damages and/or(ii) Owner may by written notice to Contractor correct the Default using another contractor or its own forces in which case Contractor shall be liable to Owner for Owner's costs of such correction including all design services and costs made necessary by such Default. Owner may deduct the costs of such correction and Damages from amounts due Contractor and to the extent such amounts are insufficient, Contractor shall pay Owner the difference upon demand. The term "Damages" shall include the costs of obtaining the services of another contractor or an employee or staff person to complete the Project and any costs of such completion (including reasonable costs and expenses relating to rebidding the work and attorneys'fees if advice or assistance of counsel is obtained by Owner, including to enforce Owner's legal rights under this Agreement) in excess of the Contract Price. Substantial Completion: The term "Substantial Completion" means when the work is sufficiently complete in accordance with this Agreement and the Plans and Specifications so that Owner can occupy or use the Project for its intended purposes and: 1. Only minor items of work that can be completed within 45 days remain to be completed. 2. . The minor items of work remaining to be completed will not significantly interfere with Owner's use of the Project. 3. A certificate of occupancy and all other permits and licenses for all portions of the Work to allow the lawful use and occupancy thereof have been issued by all applicable governmental authorities. The minor items of work remaining to be completed or corrected as of the date of Substantial Completion are sometimes referred to herein as "punchlist items." Aesthetic Appearance: Contractor acknowledges that the work involves renovation and alteration of existing improvements and, therefore, culling and patching of the work is essential for the Project to be successfully completed. Contractor shall perform any culling, altering, patching, and fitting of the work necessary so that the existing improvements will be fully integrated and present the visual appearance of an entire, completed, and unified Project.
