It appearing that notice of the hearing has been given by sending notice to the petitioners and all of those owners of property deemed to be affected thereby, and to the public by posting notice of the hearing and published in The Register, the hearing was opened and held on the date stated above. The Petitioner, Stephanie L. Babetto, was present representing herself. Ms. Babetto resides at 44 Madison Avenue, South Yarmouth and seeks a Special Permit under Zoning By-law 407 for a Family Related Apartment and a Variance from 407.2 (#7) to exceed 800 square foot maximum requirement. Ms. Babetto appeared before the Zoning Board on September 13, 2018 and following lengthy discussion was asked to continue to provide the Board with copies of any permits received, and drawings of what the area looks like. At the September 27th hearing date,Ms.Babetto passed out the requested documents. At the prior hearing Ms. Babetto stated that the work is 70% completed and was started prior to getting any permits. Tim Sears, Building Inspector, was in attendance and addressed questions from the Board. Mr. Sears stated that a Stop Work Order was issued on this property and still has open permits. According to the Building Permit that was received at the hearing and marked as Exhibit 1, it reads: convert existing garage into kitchen, finish basement space, and install slider for walkout p. basement, no additional bedrooms per Board of Health. Creating a separate dwelling will require approval from the Board of Appeals. The Board felt that the Petitioner was aware of the procedure and would need to reduce the square footage in the garage apartment that she created. The Board itself had many concerns with the project and by way of questions appeared that the Petitioner would not receive a favorable vote. Ms. Babetto requested to withdraw without prejudice. Mr. Igoe made a Motion, seconded by Mr. Neitz to allow withdrawal of both forms of relief, without prejudice,to which a unanimous favorable vote was given.
