Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of property as required by law, and to the public by posting notice of the hearing and publishing in The Register,the hearing opened and held on the date stated above. The Petitioner seeks a Special Permit pursuant to Zoning Bylaw §104.3.2(2), in order to alter a legally pre-existing non-conforming single family dwelling. The property is located in the R-25 Zoning District, and contains approximately 5,750 square feet of area. The property is currently improved with a two-story single family dwelling, with 3 bedrooms. The house complies with all setback requirements,and the building coverage is currently calculated at 9%. By way of history, this property was the subject of a hearing on May 24, 2001, wherein the then Petitioner requested a Special Permit under the old Raze and Replace Bylaw, §104.3.2.5, to raze a lawfully pre-existing, non-conforming residential dwelling and to replace it with a new, single- family residential dwelling. At that time, this Board granted a Special Permit (3683) to allow the Petitioner to increase the living space of the structure by 10% or 71 square feet. In September of 2006, after the creation of the new Raze and Replacement Bylaw, namely §104.3.2(2), the then Petitioner appeared again to request that the second floor cathedral ceiling, which had been created in order to control the square foot increase during the first hearing, be allowed to be a full second floor. The request to the Board was for a Special Permit or to modify the existing Special Permit. However, if no Special Permit had been issued in 2001, the Petitioners would have accomplished their project by right. A modification was granted in Decision 4068. , / The proposal is to add a two story open air porch to the front of the house. The front yard setback will still be met easily. Building coverage will increase to 15.5%, but well below the maximum of 25%. The Board was satisfied and agreed that the proposal meets the requirements of§104.3.2 and that the expansion of the structure would not be substantially more detrimental to the neighborhood, zoning district, or Town, than the existing non-conforming structure. The Board was also sympathetic to the Petitioner's ongoing obligation to appear before the Board for relief that would have been permissible by right if not for the need for the initial Special Permit in 2001. Accordingly, a Motion was made by Mr. Igoe, seconded by Mr. Baron, to grant the Special Permit, as requested, with the condition that the new porch areas will not be converted for use as habitable space. In addition, the Board determined that any future alteration or extension of the structure which meets all of the bulk requirements of the Zoning Bylaw may be approved by the Building Commissioner rather than being sent mechanically to this Board for relief. The members voted unanimously in favor of the Motion. No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein, the Special Permit shall lapse if a substantial use thereof has not begun within 24 months.
