Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of
property as required by law, and to the public by posting notice of the hearing and publishing in The
Register, the hearing opened and held on the date stated above.
The Petitioner, Matt Emery, presented his Petition for grant of relief from rear set-back and side line
requirements in connection with his desire to raze and replace a pre-existing, non-conforming out
building at his property located at 1 Clara Street, South Yarmouth, MA, property in an R-40 Zoning
District.
The current building, a shed, encroaches in both the rear and side (northerly) set-back requirements.
The Petitioner proposes construction of a 32' x 16' shed/garage type structure to accommodate in part,
pool servicing equipment for his existing swimming pool.
Though initially seeking side-line relief, the Board noted and the Petitioner agreed, that the structure
could easily be moved further south, into the yard and thereby the side set-back encroachment
remedied.
Correspondence from the rear neighbor and recognition that the rear set-back relief was minimal
caused the Board to concur that relief could be granted without resulting in any hazard, nuisance or
congestion while preserving the current and future character of the neighborhood and Town.
Motion was made by Mr. Igoe, seconded by Mr. Neitz, to grant the Special Permit on the conditions
that:
1) That the building location be at least 20' from the Northerly side line;

2) That there be no human habitation of the structure;
3) That there be no bathroom facilities within the structure; and
4) That the building remains at least 15' from the rear side-line.
The Board voted unanimously in favor of this Motion, with these conditions and the Special Permit
was so granted.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. This decision
must be recorded at the Registry of Deeds and a copy forwarded to the Board of Appeals. Appeals
from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days
after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein,the Special
Permit shall lapse if a substantial use thereof has not begun within 24 months.(See bylaw,MGL c40A
§9)

Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of
property as required by law, and to the public by posting notice of the hearing and publishing in The
Register,the hearing opened and held on the date stated above.
The Petitioner, Matt Emery, presented his Petition for grant of relief from rear set-back and side line
requirements in connection with his desire to raze and replace a pre-existing, non-conforming out
building at his property located at 1 Clara Street, South Yarmouth, MA, property in an R-40 Zoning
District.
The current building, a shed, encroaches in both the rear and side (northerly) set-back requirements.
The Petitioner proposes construction of a 32' x 16' shed/garage type structure to accommodate in part,
pool servicing equipment for his existing swimming pool.
Though initially seeking side-line relief, the Board noted and the Petitioner agreed, that the structure
could easily be moved further south, into the yard and thereby the side set-back encroachment
remedied.
Correspondence from the rear neighbor and recognition that the rear set-back relief was minimal
caused the Board to concur that relief could be granted without resulting in any hazard, nuisance or
congestion while preserving the current and future character of the neighborhood and Town.
Motion was made by Mr. Igoe, seconded by Mr. Neitz, to grant the Special Permit on the conditions
that:
1) That the building location be at least 20' from the Northerly side line;
1
2) That there be no human habitation of the structure;
3) That there be no bathroom facilities within the structure; and
4) That the building remains at least 15' from the rear side-line.
The Board voted unanimously in favor of this Motion, with these conditions and the Special Permit
was so granted.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. This decision
must be recorded at the Registry of Deeds and a copy forwarded to the Board of Appeals. Appeals
from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days
after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein,the Special
Permit shall lapse if a substantial use thereof has not begun within 24 months.(See bylaw,MGL c40A
§9)
